Show day of juteuners 1 1TEB CASE Day in Court Devoted to Claims of Contending Counsel. Arguments in support of the motion for a judgment for the defendants on the pleadings took, up the day yesterday in the trial before Judge W. H. Bramel of the Third district court of the suit brought by the West Cache. Sugar company com-pany against 'J. "A. Hendrickson and Lorenzo N. Stohl to recover $197,000 which the complaint alleges they fraudulently fraudu-lently abstracted from the company's assets, and $100,000 as damages for alleged al-leged injury to the company 's business standing and efficiency. Argument against the motion will be begun by counsel 4for the plaintiff at 10 o 'clock this morning. Argument in favor of the motion for a judgment for the defendants was made by Attorney E. A. Wedgwood, seconded by Attorney Thomas Marion-eaux. Marion-eaux. Attorney Wedgwood contended that the "state law will support the action ac-tion of the defendants in turning over the Knight Sugar eo'mpany's plant to the West Cache Sugar company for, a stipulated amount in excess of the cost of the plant to them. Counsel contended contend-ed that the company is irrevocably btuuiil because of 'inclusion of the terms of the sale to the West Cache Sugar company in the company's articles of incorporation. Attorney Marioneaux attacked the pleadings of the plaintiff in the case, arguing that they, do not state a cause of action, that pleadings do not charge fraud, and that, so far as the pleadings of the plaintiff are concerned, the defendants de-fendants are secure iu point of law. |
