Following tho overruling of an ob-joction ob-joction offered by counsel for the defendants, de-fendants, evidence-takina; was beun yesterday before Judo V. II. Bramel of the Third distriet court in the suit brought by the West Cache Sugar company com-pany against J. A. Hendrickson and Lorenzo X. Stohl. Tho day was taken up with the direct testimony of J. ! 1'eatherstone, who told how he became identified with promotion pro-motion of a suar factory for West Cache valley early in 1916, bein" associated asso-ciated with Mr. If endrickson. He identified iden-tified contracts introduced as those he had obtained from the farmers of the locality for raising beets, tho contacts bein "drawn in the name of P. A. Hendrickson Hen-drickson as anient for the West Cache Suar company, to be incorporated. Sub-,-:eipient to securing the contracts, the witness testified, Mr. Hendrickson agreed to share equally with him if he could pet the undertaking financed, giving giv-ing him a letter of authority to negotiate nego-tiate on behalf of the proposed company, com-pany, j Mr. Stohl, according to Mr. Feather-1 stone, was taken into the enterprise through the mediations of tho witness, with the understanding that he should have half of Mr. 1'eatherstone 's interest, inter-est, or a one-fourth share in the profits of tho enterprise. Negotiations for tho plant of tho Knight Sugar company were preceded by negotiations for a plant which the witness knew in California. Cali-fornia. Ultimately, Mr. Fcatherstone was induced to take $1000 for his share of the profits, Mr. Hendrickson and Mr. Stohl representing to him that the total profits would not exceed $5000, from which the expenses must be paid.
