I Decision was handed down yesterday I In the supreme court in the case of John J Preece,' respondent and cross-appellant, ! against tho Oregon Short Line railroad, 'appellant. The action was brought to recover the value of .certain horses and cattle alleced lo have Wen killed in Davis county. The plaintiff recovered in certain cer-tain instances. Legally (lie case was complicated be-I be-I cause of the fact that there were seven causes of action stated in t he case. it deals with the responsibility in the case of the killing of animals on the right of way. Justice Krlck stated that his associates asso-ciates had reached the conclusion that the iudgnient of the district court should be afiirmed in certain causes and that it should be reversed and a new trial granted grant-ed as to one specific instance.
