Show I FALSE AFFIDAVIT IS CAUSE OF DISMISSAL Judge Armstrong Refuses to Hear Divorce Di-vorce Suit Brought by W. O. Barrie Against "Wife. ( Discover' that the plaintiff had made a false affidavit ae to the residence of the defendant, Induced Judge George G. Armstrong of the district court to refuse yesterday to hear the divorce suit brought by Walter C. Barrie against Justine Jus-tine Eleanora Barrie. Barrie in his affidavit swore that his wife residod In Los Angeles and It was shown In court yesterday that he knew she lived at Pasadena, Cal., and that he liad written to her there at about the tame time he made the affidavit alleging that she lived in Los Angeles. The purpose of the false affidavit is said to have been to prevent service of summoas upon Mrs. Barrie, so that Barrie Bar-rie could obtain his divorce by default-It default-It transpired yesterday that Mrs. Barrie is suing Barrio for divorce in Los Angeles. When the county clerk's office failed to obtain service of the summons on Mrs. Barrie under the affidavit made by her husband, the papers were returned and It was reported to the court that the defendants de-fendants whereabouts could not be dls-v dls-v covered. Later, however, Mrs. Barrie learned of her husband's divorce action and forwarded an affidavit yesterday to the effect that her husband xveL knew that she lived at Pasadena. Judge Armstrong administered a sevore rebuke to Barrie and declined to hear the case until proper service had been made. |
