Show ALLEGED SLAYER OF liOWIDEIIFIED Two C3'e-witnesacs to the killing of Joseph Jfainbow testified yesterday in tho trial of Tdcllus M. Dye, charged with the crime, and both of the witnesses wit-nesses trwore that the defendant is the man who firod the fatal shot. Androw M. Patros and Agnes Neileon, who were held up by a highwayman, were placed on tho stand by District Attorney Attor-ney Leatherwood. Patros was tho first witness, after which John E. Mackay of. the county engineer's office swore to the correctness of a map introduced in evidence. Miss Noilson was, placed on the stand during tho afternoon session ses-sion of court and was under cross-examination when the hour for adjournment adjourn-ment arrived. Both Patros nnd Miss Xcilson told of! .Rainbow approaching the spot whore they were being held up and of the ! highwayman fs command to Ttainbow to "hold up your hands." Thoy testified! that Rainbow startod to obey the command, com-mand, but suddenly broke into a run and the robber fired. They were certain cer-tain of the identity of tho highwayman and could not be made to contradict or modify tho identification of-D'e. The state probably will conclude the introduction o its evidence early tomorrow. |
