Show j JAMES GIBSON FINALLY LOSES DAMAGE ACTION Jajnes Gibson, the former well-known doorkeeper at tho Salt Lako theatre, lost his damage suit against George G. Doyle Co. Tuesday when the snprnme court handed down an opinion affirming the judgment of the lower court lu favor of Doyle .t Co. The suit was brought to recover damages dam-ages in tho sum of r25,nn0 for Injuries reclvcd by Gibson at the Z. C. M. I. Feb J, 1107. It was set out that filbaon was working at the 'A. C. M. I. and on the date mentioned Doyle k Co. wero doing some plumbing work ihero and ono of Iho employees of Doyle left a large wrench on top of a step ladder which fell off and hit Gibson on the head, permanently per-manently Injurinc him. The plumbing- concern claimed that tilbson was guilty of contributory negll-genco negll-genco In that he permitted a door through which ho .wa passing to hit agaln.it the ladder, and thereby causing the wrench to fall off. The Jury In the lower court found in favor of Dovle & Co.- no i-aur-e of action, and Gibson appealed. ap-pealed. The supreme court could find no reason for changing the judgment of the lower court. Justice Frlck wrote the opinion, Chlrf Justice straup' and Justice McCarty concurring. |
