Upon this occasion, Mr. Martin scored. Ho was there to contest tho motion of Van Oott, Allison & Riter that tho Union Trust company, a defendant de-fendant in Mr. 7aphael's suit, be dismissed. dis-missed. It was explained by Mr. lUter, who appeared in support of the motion, that tlie attorneys thought they had included in-cluded the trust company in a former motion which resulted in the dismissal of Denver & liio Grande and the Hio Grande Western, but discovorod later that, they had not done so.
