Clark over the construction construc-tion of the San Pedro, Los Angeles and Salt Lake rallrond, which ended In the purchase of Harriman s Oregon Short Lino road from Salt Lako to Callento by the Clark Interests and the flnnl com- plction of tho new lino to the coast, was revealed in a suit for 3200,000. brought by Patrick B. McKcon in the District court Saturday against the Oregon Short Line Railroad company. i What Is Averred. Tho complaint avcr9 that In February, 1902, the Oregon Short Lino company "was desirous of extending Its lino from Uvnda, Utah, to Calient''. Nov.. and beyond be-yond thnt point to Los Angeles. To do so It was absolutely necessary to secure possession of a certnin railroad grade from Uvnda to Caliente, and to prevent the Clark road from gaining possession of the same grado. It Is alleged that the disputed grade was worth to cither company com-pany not less than J2.000.000. The complaint com-plaint then recltus as follows: Contest for a Grade. "Plaintiff further avers that on, to-wit: February 1. JF02. snld defendant company specially requested this plaintiff to gain possession of tho said grade for It at any cost, and at tho dato last aforesaid the said Sail Pedro, Los Angoles and Salt Lake Railroad company was endeavoring, with a largo forco of men and teams, by force and violence and otherwise, to gain possession of tho said grade, and -there was thereupon precipitated a contest and ru struggle between the said railroad com-pnny com-pnny defendant herein and the said San Pedro. Los Angeles nnd Salt Lake Rallrond Rall-rond company, nnd a race of diligence ensued between tho two corporations for tho possession of sold grade. Agreed to Gain Possession. "And thereupon this plaintiff, pursuant to tho request of the said defendant railroad rail-road company, as aforesaid, undertook and agreed to gain possession of the said grado for tho said defendant railroad company, and with a large force of men and teams entered Into said struggle against the said San Pedro, Los Angeles and Salt Lake Railroad company, acting act-ing for and on behalf of this defendant railroad company, and did gain possession posses-sion and complete control of tho said grade between Uvnda nnd Caliente, ns aforesaid, for tho benefit of the said defendant de-fendant company, and thereby prevented the said San Pedro. Los Angeles and Salt Lako Railroad company from gaining possession thereof, and thereafter, and by reason of the labors of this plaintiff In Its behalf, the said defendant company ' built Its railroad along and upon said grade from Uvada to Caliente and beyond." be-yond."
