| Show LIE PASSED IN COURT Exciting Incident During Trial of Lindsays Suit Against St Marks Hospital In the couoe of an argument In Judge i Stewarts court yesterday morning P L Williams attorney for St Marks hospital et aL lost his temper and referred re-ferred to another legal luminary as a liar The remark created quite a llttlo sensation among the few people In tho court and was finally withdrawn together to-gether with the allegation that had provoked It Mr Williams1 display of temper was partly due to the able and somewhat satirical argument of Judge J W Mul lahey of Denver who represented the I plaintiffs The suit was that of E A Lindsay who asked 10000 damages for malpractice Lindsay compromised the suit without the consent of his attorneys attor-neys Judge E V HIggins and G A Udell of Eureka who In their own Interests arc piesslng the case with a view of recovering a contingent fee In his answer to the complaint Mr Wil hams alleged that the attorneys Hlg gins and Udell had fomented trouble with Improper 11l0tles He set lip the relcaye signed by Lindsay as a defense The plaintiffs moved to strike out the alleged new mailer In the answer on tho ground that It was Irrcvelant Im material scandalous and defamatory Judge lllgglnt Intimated that the at torney for the defendant had taken advantage ad-vantage of Lindsays Ignorance to got the release signed In icply l Judge Williams retorted that If Judge Hlgglns meant that he had Been Lindsay sign the release he Hlgglns wits a liar The court was astounded and before he recovered himself nuMlclonlly to call for order Mr Williams had apologized Judge Illgglns nskcd that the remark be MJJidrawn but Mr Williams re fused to no this until Judge Higgins withdrew his intimation Doth were finally withdrawn and the Incident closed The motion to strike out waa taken uiUler aavlsemcnt by the court |
