| Show INQUEST GOES OVER County Attorney Confronted by Lack of Evidence SLAUGHTER OF JENNINGS Employees of Barney Eckstein Refused Re-fused to Testify as tho Authorities Thought They Were Going To Trustie and Sherbrook Drew a Lurid Picture of a Reign of Terror Alleged to Have Been Inaugurated by JenningsAutopsy May = BeHold Be-Hold on the Body Today The county authorities find themselves them-selves seriously handicapped In their efforts to prove the killing of J A Jennings felonious by the unwillingness unwilling-ness of Ecksteins employees to teotifj as the authorities think they ought to After the examination of two witnesses before the Coroners Inquest yesterday morning County Attorney Christensen decided that some more evidence would have to be worked up before the State could make any kind of a showing at all against Eckstein Accordingly the Inquest was continued until 30 oclock Monday morning and Deputy Sheriff Raleigh was dispatched to the roadhouse road-house to get some evidence that would help out the case Instead of upholding tho official theory that Jennings had been robbed and murdered the testimony of Frank Trustie and A E Sherbrook all tended to show that Jennings was a violent man and had been courting trouble It was plain that the two men were Interested In-terested witnesses but there was a woeful lack of rebutting evidence so the State was In no position to go on with the hearing Justice F M Bishop with R L Mc Ghle Idorace Stayner and Victor Chris topherson as jurors began the Inquest at 10 oclock The witnesses were examined ex-amined by Mr Christensen Mr Eck stein was represented by D N Straup of tho llrm of Powers Straup 8 Llpp nuui NEGROS TESTIMONY Trustie the negro bartender testified that Jennings came to the roadhouse between 3 I and d 1 oclock In the afternoon after-noon and bought some boer The witness wit-ness sat down and put his feet against a post Jennings pushed his feet away from the post told him to get some more beer and when he was going In the house throw him to the floor Inside In-side Jennings played the slot machine Trustie said and broke It He then demanded his money back and got It Trustie KId that Eckstein came In about dusk and that Jennings was asleep on the piazza at the time At the time of the tragedy the witness said Jennings exclaimed There la going to be something doing here right now and pointed his revolver at Eck stein who said Take down that gun and thenshot Jennings That was all that was lo he had from Tru lIe but the County Attorney hoped for something better from Shcrbrook who way 1 alleged to have said the night before that Jennings claimed to have been robbed when he pointed the gun at Eckstein STORY OF GUN PLAY Shcrbrook managed to add several lurid particulars to Trustloa tale He wild that Jennings pulled a gun on Trustie when he called for beer and threatened to kill both Trustle and the witness He said they locked the doors to keep Jennings out Shc rook claimed he was In the parlor at tho time of the shooting and heard Jennings Jen-nings say there was going to be something some-thing doing but denied that he heard anything from tho dead man about being be-ing robbed When asked why he had made such a statement the night before he said he was under the Influence of whisky and morphine Sherbtook Is a confirmed dlmonovel reader Ho came here from Seattle and was at first employed as an electrician To his friends he has told of killing two Chinamen In British Columbia In yelfdcfengc but l as he hJ I an undersized under-sized man with no moro nerve than a chicken they ascribe his exploits to a too vivid Imagination i Sheriff Nnylor testified as to tho position po-sition and appearance of the tyody when he reached the scene of the shooting and Dr Mayo described the wounds MAY HOLD AUTOPSY Although there Is I no doubt that an autopsy would show whether or not Jennings was drugged before thcmur der none has been held It lo possible that a postmortem may be ordered to day to determine this point Barney Eckstein Is still In Jail and i will be held at least l < until after the inquest In-quest Two of the witnesses who will be examined Monday have stated that I Jennings came Into the saloon about I twenty minutes before he wns shot and walked around flourishing his gun and I saying he had been robbed |
