Show AfTER WATER RIGHTS Many Applications Filed With State Engineer BETTER IDEA I OF THE LAW Miners Getting Possession of Small Streams Unusual Activity of Men in All Parts of the State Indicated by the Filings A batch of applications for water appropriatIons ap-propriatIons were filed with state Engineer En-gineer A F Doremus tho past week One of the applications had to be rejected re-jected as it comes under the provisions of the Jaw upon which AttorneyGen eral M A Breeden rendered an opinion In cases where the available supply has already heen appropriated An erroneous Impression r has also gone forth that the new law disturbs vested rights and that the holders of such rights must make a second ap L pnuiiuon 10 retain their appropnatipn In order to correct this Impression need of such an appropriation has been understood that only in cases where new water rights arc sought will 11 be necessary to make applications for appropriations The new law Is not Intended to disturb vested rights and only after the hydrographic survey has been completed on any stream will It be necessary for water users to prove their claim before the court Every water taker will have timely and due notice of when he should act CAUSE OF FAILURE One company which made application applica-tion for water privileges forfeited Us right to complete the application because be-cause it failed to file with the State Engineer within sixty days as required re-quired by law the maps profile and drawing which are a part oC the application appli-cation This happened in the case of the Columbus Consolidated Mining company which originally applied for an appropriation from the Little Cottonwood Cot-tonwood creek An application for twelve second feet was made by Arthur Ar-thur E Snow who wants to take the water from the creek about four miles above the Wasatch for power purposes The Columbus people made application for the same supply but failed to meet all the requirements within the speci I fled time FOR SMALL FLOW The Waoatch King Mining company applied for an appropriation of 003 second feet of water from the Wasatch Springs and Beaver Lake mining districts dis-tricts In Beaver county to be used for culinary and mining purposes D H Peery applies for five second feet of water and IzArlght mh mh mh mhh water from Red Pine gulch In the Little Lit-tle Cottonwood canyon The water is i wanted for power purposes IN MINING CAMPS Thomas L Wlswall and Morris E Billman apply for three second feet of water from ranklln Springs to be used by the Camp Floyd Mining company for milling and mining purposes Thomas L Wlswall also applies for an appropriation of five second feet from the W J Bryan tunnel In the Little Cottonwood canyon to be used for mining min-Ing purposes and power This is the application which was rejected on the advice of the AttorneyGeneral because be-cause it sought to appropriate water for which application had already been made by D H Peery OTHERS APPLY The Continental Mines and Smelting corporation wants twenty second feet of water out of the Little Cottonwood creek to be diverted at a point two and threefourths miles above the Watch for power purposes Stephen Hayes Charles H Roberts A V Anderson and A L Heaston ask for five second feet from the Bingham Canyon creek for protection against fires In the town of Bingham It is understood that the State Engineer Dorcmus desires It fell since the occasion of the recent Ire which promised at one time to destroy des-troy the town |
