Show TREATY IS QUESTIONED Constitutionality of Blaine Extradition Extradi-tion Treaty to Be Tested Chicago Dec 10The question oC lie constitutionality of tthe Blaine extradition ex-tradition treaty between GrcAtBritain and the United States signed by rep resentativesof tlioftwo Governments in 1S89 and which it IB tbacrted has never been passed upon is to be brought before the United States Supreme Su-preme court Jn the cases of Fred Leo Rice Frank Rutlcdue arid Thomas Jones who were arrested In Chicago last June on the request of the Canadian Cana-dian authorities charged with being fugitives from Justice The specific charges against the three men Included Includ-ed complicity in several bank robberies robber-ies In Toronto and other Canadian cities President McKinley Issued a warrant for the requisition of the three men but action was prevented by a writ oC euperscdeas issued by Judge Kohlaaat of the United Stales District court and since last June the men have been confined con-fined in the county jail Next Monday attorneys representing the prisoners and the British Consul will appear before the Sunrcme court at Washington and bail fgivthc prisoners prison-ers will be asked pending the construction construc-tion of the Blaine treaty Attorneys for the British Consul will move to dismiss the appeal or advance the coso to an Immediate hearing The case is regarded as one of great importance not only in this country but In the Queens Dominion as an opinion from the Supreme court will be regarded as settling the mode of procedure to be adopted by the extradition extra-dition commissioners in international extradition cases Should ball be refused re-fused the prisoners they may remain In Jail here for a year before the case Is passed upon It was in the cell of Fred Rice that a revolver was found concealed in u basket of grapes some three weeks ago and since that time the men have been closely watched |
