Irvine Hurder Aiste dew? VB temore Cieneral Court" Xotes. The first case called for trial in the Third district court this morning was that of Davis 6c Stringer vs. F. K. Morris, in which the plaintiffs sued to recover ?375 commission commis-sion on a real estate transaction. The case was tried before the court and taken under advisement. The following venire for petit jurors was returned: Chas. Brooks, A. L. Brown, F. D. Palmer, J. D. Brown, P. II. Taylor, J. P. Maban, C. E. Angell, W. H. Scils. The order excusing J. E. Caine as a grand juror was set aside and Joseph will serve for the retnaiuder of the terra. In the case of Wm. Pcrego vs. Wm. H. Dodge et ai., a motion for a new trial and to set aside judgment was overruled. In the afternoon the case of W. H. Jay et ai., vs. B. F. Whittemore came up, W. H. Dickson appearing for the plaintiff and Colonel Kaijrhu for the defendant. It seems that Jay Black, in 1890, took the contract con-tract to construct the Union Pacific hotel for some $20,000. This action is brought to recover $4;Ut alleged to ba due on the contract. con-tract. The defendant alleges a breach of contract and puts in a counter claim for $7,976.63. The trial was in progress when the court adjourned. A Kig Damage Suit. Barney Keogh, this afternoon brought suit against the Rio Grande Western Rail, way compauy. In his complaint tbe plaintiff plain-tiff alleges that in May, he was employed by the defendant as a laborer, and was ensraed in repairing a tunnel at Kyuue; that the defendant de-fendant carelessly permitted the roof of the tunnel to become unsafe, and by reason of the company's negligence in this respect a cave resulted, and the defendant was badly and permanently injured. Mr. Keough claims damages in the sum of $15,000. Denton & McNally were the plaintiff's attorneys. at-torneys. A Divoroo Case. W.J.Jenkins today . brought suit for divorce di-vorce against Mary Ann Jenkins. The parties par-ties were married in this city way back in '58 and the plaintiff alleges that in 1873 the defendant unlawfully ana without cause deserted de-serted him. He asks for an absolute decree of divorce. v Probate Court. Estate of Jennet Ritter, deceased; order made fixing Thursday, October r 13, to hear final account and petition for distribution. Estate of Jacob Larisch, deceased: order appointing appraisers and order of publication publica-tion of notice to creditors made. Estate of Arthur Porcher, deceased; order appointing appraisers msde. Court Notes. The case of M. B. Buford vs. George Webster Web-ster et al. has been dismissed for want of prosecution. J. Y. Marshall, a noted Leadville attorney, is in town. The gentleman is considered one of the ablest mining lawyers in the West. In the case of D. D. Mallory and J. W. Donnellan vs. Clsra E. Rellly, judgment has been entered for the plaintiffs for 1,492.80, j and a decree of foreclosure grsnted. The trial of W. H. Irvine for killing Montgomery, Mont-gomery, beeins at Lincoln, Neb., on October Octo-ber 3, and Fred McGurrin has been commissioned com-missioned to take the depositions of Judges Zane and Anderson, C. C. Goodwin, Governor Gov-ernor Thomas, G. M. Downey, I. A- Benton, Secretary Sells. R. G. Sleator, F. T. Hiatt, J. M. RIcketts, V. E. Hubbsrd. The depositions deposi-tions will be as to the defendant's reputation reputa-tion for peaee and quietness. . The Grand Jury. -The grand jury today investigated the ease of John Creamer, the man who shot Jerry Richardson a few weeks ago in the Walker bouse, because of alleged undue intimacy of Richardson with a daughter of Creamer's. The investigation we a short one. Richardson Richard-son has recovered from the pistol- wound inflicted in-flicted by Creamer and is about the city once more. - -.- . The case of Fowler, the carpenter, who is alleged to have committed adultery with his stepdaughter, was also to have Been investigated investi-gated today. - v . |
