The first motion mo-tion to secure final action from tho supreme court of the United States on tho question of the constitutionality of the New York electrical execution law was mado in the suprome court yesterday. yester-day. It was moved that the case be advanced ad-vanced and set for speedy hearing. The point raised is that Kemmler's execution demonstrated that killing by electricity was a cruel aud unusual punishment, and, ' as such, was prohibited pro-hibited by the constitution of the United States. After counsel had made the motion, Chief Justice Fuller asked: "Is there any distinction between that case and the case of Kernmler?" Daniel O'Callahan, tho counsol who made the motion responded. "Yes sir; this distinction, that the carrying out the sentence in the Kemmler case was not scicntifitally successful and the petitioner hopes elec tricity will be decided to be not a proper mode.
