Wallace; Wal-lace; motion to set aside the order made yesterday modified, the plaintiffs plain-tiffs having leave to -amend upon payment pay-ment of $5 costs; defendant w;ts (granted ten days in which to amend his answer; defendant's attorney except. ex-cept. Alexander Toponce cs. Thomas Mahau; demurrer withdrawn and five davs given in which to answer. W. II. Pitts ct al. vs. 11. C. Chambers; Cham-bers; by consent of parties it was oidered that until further order of the court or judge, the defendant was enjoined en-joined from extracting any ore from the ground in conflict, and was enjoined from mining upon the King of the West claim; but the defendant was not prohibited from the use of the CityRock lower tunnel, the mouth of which is within the ground in dispute; dis-pute; and botli parties, with surveyors, sur-veyors, assistants and experts, were allowed full access to the works for making examinations and surveys. F. M. Smith v.. Thomas Fitch; defendant's de-fendant's counsel excepts to the order referring to extend the time to file affidavits of merit. Smith & Jonasson vs. W. J. A. Umback; judgment entered for plaintiff's plain-tiff's by default. S. J. Dean vs. W. V. Co.; plaintiff moved to stiike from the files the affidavit of N. M. Maxwell, sworn to on the; 7th day of April, 1874,or to expunge tnerefrom. the statement of a conversation sworn to have been had between him and tho pla;ntifT ; and also Tne affidavit of J. V. H. Patrick, sworn to on the 7th day of April, 1S74; on the ground that said affidavits affi-davits and the matter therein are scandalous and impertinent. Ordered that the motion may be heard on Monday next. Wells, Fargo & Co. vs. E.D.Ralph; demurrer withdrawn and judgment entered for plaintiffs. L. Goldberg & Co. vs. Isaac Woolf; demurrer to answer sustained and defendant given till Mondav morning to file an amended answer. Fred. J.
