I i Ycnterday eveniug the Territorial 'mirhal, having in charge a number oi i men in whose case a nolle prosequi was 'entered in the district court yesterday, 'and being without authority to longer detain them, .cet them at liberty. .Several of them we hold were entitled to their liberty months ago, in fact that : they should never have been deprived , of it on the charges for which they were arrested, because we believe them to be entirely innocent of the accusa-j accusa-j tions made against them, and that a j fairly-drawn, honest, unprejudiced grand jury would never have found indictments in-dictments in their cases. The men to whom wc refer are Hosea Stout, William Wil-liam Kimball, John L. Blythe, B. Y. Hampton, James Toms and Alex. Burt. Wm. A. Hickman was also set at liberty, no person appearing to make affidavit against him, his own confession, confes-sion, we presume, being the principal evidence on which he was indicted. Eor monihs the others have been held in conlincment, their business has suffered, odium has been sought to be, cat upon their names, and now they are set at liberty, all because judicial authority was abused and law wrested to accomplish a mission. While we believe them innocent wc hold, and all who desire to see truth vindicated vindi-cated and justice magniQed must desire, that the charges against them should be fully investigated and their innocence established beyond cavil. It should be known whether any stronger evidence can be produced than the testimony tes-timony of a self-proclaimed assassin and an acknowledged perjurer. The prisoners under commitment, but against whom indictments had not been found, to tho number of twelve, were taken by the Territorial marshal to the county jail and there confioed. Camp Douglas is relieved from the charge which has been forced upon it 1'or over a year, of being the common jail of the Territory. We congratulate General Monow. |
