Show Could there be found a Supreme Court, Territorial or State, in the United Uni-ted States, except in Utah, that would sustain the decision given by the Supreme Su-preme Court of this Territory ruling out all Territorial officers? We think not. And should a case involving its soundness come before the Supreme Court of the llepublic, we have not the shadow of a doubt but that high tribunal tribu-nal will pronounce emphatically against the anti-republican doctrine thus at- tempted to be laid down. Chief Justice Jus-tice Lewis of Idaho, gave precisely the same ruling, influenced by strong partisan par-tisan prejudices, but his colleagues, the Associate Justices, would not sustain him in it. Yet that very point is the cause of all the judicial difficulty here for the past nine months. It was deemed necessary that certain offices should be declared void, because the men filling the offices were not the men wanted. Xot law but expediency had highest consideration. |
