| Show GRIFFIN IS GUILTY Burglarized the Holy Cross Hospital Hos-pital on Christmas Day AGAINST THE CITY RAILWAY THE JURY AWARDS MRS MARY E SMITH 2500 DAMAGES Rio Grande Western Railyray Sued for 1742 for Damage to Cattle in Transit Charles OMan Sent to the Reform SchoolThe School Maam and Mrs Dartnell Have n Fistic Encounter John Nielsen of the National Guard of Utah Charged with Perjury James Griffin was put on trial for burglary bur-glary in Judge Bartchs court yesterday morning The defendant was indicted on the charge of having on the night of December De-cember 2 broken Into the Holy Cross hospital and stolen therefrom about 200 in cash Griffin was arrested by the police the day following the burglaryqand about 10 was found in his possession Assistant District Attorney Howat prosecuted and Attorneys Morris Som mers and J H Murphy defended the accused I was shown on the part of the prosecution prose-cution that the defendant was occasionally occasion-ally employed at the hospital between the months of August and December last year having given his name there as Jams Brown On the morning of Dam ber 26th a window leading into the office was found open and it was then discovered discov-ered that a drawer in a desk in which money was kept had been forcibly opened open-ed and its contents about 200 taken I was stated In evidence that the defendant defend-ant was seen around the city just after I the robbery soending his money with a free hand anti that about December 27th he deposited the sum of t30 with Mr Reilly at the Clift House hotel A saloonkeeper saloon-keeper named Louis Hobein with whom the defendant had roomed also testified that Griffin about 3 oclock on the morning morn-ing of the 26th of December entrusted 63 in his hands for safe keeping The defendant went on the witness stand He made a long rambling statement state-ment the effect of which was that he knew nothing I whatever of the robbery that he was not anywhere near the hospital hos-pital at the time and that being a man of sober habits the money which he handed to others to keep for him was the proceeds of his earnings and savings He admitted to Prosecuting Attorney How a having played faro about Christmastime I Christmas-time and lost and that he might have enjoyed himself more than usual at that festive season I The case reached the jury about 330 oclock and at 5 oclock a verdict of guilty was returned The defendants attorneys at-torneys gave notice of motion for a new trial Attorney McEneny on behalf of the Holy Cross hospital asked that the money found with the defendant and which he was convicted of stealing from the hospital be turned over to the hospi tal but in the absence of the district attorney at-torney Judge Bartch would not make any order in that regard and the matter I Will be brought up again probably today I |
