The trial of Nellie Davis a large woman of about 40 years of age who at one time was proprietress of a boarding house and an alleged house of illfame on Franklin avenue was commenced before Judge Bartch and a jury yesterday afternoon The charge against Mrs Davis is that of enticing Edith Karren the 15 yearoW daughter of City Marshal Karren of Lehi into a house of ill fame for the purpose of prostitution on Nov 29 1S93 The girl was found in the house by the police in an unconscious condition on the same night and Billy Lynch the prize fighter was arrested on the charge of having committed fornication fornica-tion with her Lynch was afterwards indicted by the grand jury and is now awaiting his trial Assistant District Attorney Howat prosecuted and Attorney S P Armstrong Arm-strong appeared for the defense At the suggestion of Mr Howat the case was heard behind closed doors Sergeant Ford Examined Sergeant Ford was the first witness examined for the prosecution He tes tided that the defendant was formerly a cook in a house of illfame on Franklin avenue On the night of November No-vember 9 he found Edith Karren in the house No 5 Franklin avenue where Mrs Davis lived Edith was in bed when he found her Mrs Davis daughter conducted the house on Franklin avenue Sarah L Karren mother of the girl Edith said her daughter would be 16 years old next March She left home for the first time about six weeks before be-fore her misfortune to stay with a family named Benion at West Jordan Mrs Benion was the girls aunt When she came home after being absent ab-sent six or seven weeks she did not appear natural her face was swollen and her lips scratched and blue She complained of feeling unwell Her conduct and behavior while at home was always good C H Karren father of Edith said he was city marshal of Lehi and was engaged in the stock raising business He came to Salt Lake on Nov 30 and took his daughter home She was in a bad state when he found her At I home she had always been a modest good girl girl3Iiss JIbs Karren Testilies Edith Karren was next examined She is a rather goodlooking girl of 15 but looks older She told how she left home to stay with her aunt Mrs Ben I ion and a couple of weeks afterwards came to Salt Lake and worked at the Templeton hotel and other places for a few weeks On Nov 29 after leaving leav-ing the hotel she went to an employment employ-ment office to seek employment and I not being acquainted with the streets in Salt Lake lost her way and wandered wan-dered into Franklin avenue along in the afternoon She did not know any thing about the reputation of Franklin Frank-lin avenue She saw the defendant standing at the door of the house and asked her to direct her to Second South street She told the defendant she was out of employment and the defendant asked her into the house and promised to help her to get employment She went in and was introduced to the I daughter of the Davis woman They had some wine and beer and she spent the remainder of the afternoon there and in the evening Billy Lynch and another man came to the house The wine and beer made witness sick and Stupid and Lynch took her into a room and they occupied the same bed that night Crossexamined by 11 Armstrong witness admitted that she had been discharged from the Tempeton hotel for bad conduct and bad talk While at the hotel she had several times gone out with one of the bell boys once to a dance S Remove your hat said Mr Armstrong Arm-strong Why should she take off her hat asked Judge Howat Mr ArmstrongI want to show her general appearance The witness was proceeding to takeoff take-off her hat when Mr Howat interposed an objection and the objection was sus tained What name did you go by at the Tempeton Edith Karren replied the witness This closed the case for the prosecu tion and Mr Armstrong moved to dismiss dis-miss on the ground that the prosecu tion had made no case The motion was promptly overruled and the de fense opened Tire Dcfense Opens Mrs Georgie Williams examined by Mr Armstrong said she was chambermaid chamber-maid at the Templeton hotel and worked there while Edith Karren was there Ediths conduct while at the hotel was bad in the extreme She used bad and indecent language Drum Major Fair a soldier stationed station-ed at Fort Douglas testified that he had seen Edith at the house of ill fame on Franklin avenue Her conduct con-duct there during the evening was lewd and lascivious and she tried to induce men who came there to buy beer Witness was a friend of Minnie the daughter of the landlady Their friendship friend-ship was however purely platonic Sergeant Charles B Hunt of Fort Douglas testified that he had been in the house on Franklin avenue on Nov 29 and saw the girl Edith there She was quite lively and familiar with the men who came to the house She danced around and did the split act William C Jeffrey a private soldier in reply to Mr Armstrong said that he had also been to the Franklin avenue ave-nue house on the night of Nov 29 Edith Karren had acted like the inmates in-mates of sporting houses generally do She danced and went through a variety of gymnastic performances Witness was a friend of Minnie Davis Judge HowatWas Minnie a sort of daughter of the regiment No not particularly said witness Court adjourned till this morning when the case will be resumed |
