| Show Writs of Hahcos Corpus Denied In the matter of Clayton Gannet and George Ogllvle application for writs of habeas corpus Associate Justice Bartch delivered the opinion denying the applications Chief Justice Ulerritt and Associate Justice Smith concurred The petitioners were convicted of grand larceny in the First judicial district dis-trict and on March 9 1894 and Uarch 189 were sentenced sen-tenced to two years imprisonment In the penitentiary The claim for release re-lease was based on the ground that the Indictment does not change an offense of-fense under any law of this territory or if it does change an offense it Is petit larceny and their counsel contended con-tended that the statute under which the proceedings were had was repealed re-pealed before the indictment was found Cattle stealing was the crime charged and their honors held that it has been the settled policy of the legislature leg-islature to make live stock a subject of grand larceny and that there was no intention to repeal any portion of section 278 of the act of 1876 by the act of 18SS |
