OPINONS HAMJED nowar Lower Court Reversed lI tIle People vs Georero Hughes The people of the territory vs George Hughes appellant Opinion delivered by the chief justice and concurred in by Judge Bartch judgment of the lower court reversed Hughes was accused of robbery from W 11 Nichols The indictment contains con-tains two counts first taking 105 from the person and 53 from the person The facts appeared to be that Nichols had been gambling in the Fort Du chesne country and that Hughes claiming that Nichols owed him a sum of money forcibly and by threats tool the above sums from him He was charged with robbery in the First district court convicted and sentenced to two years imprisonment in the penitentiary pen-itentiary A appeal was taken on the ground of many errors in admitting and excluding ex-cluding evidence at the trial and especially es-pecially on the ground that the intent to feloniously and fraudulently take the money was wanting and that with money won at gambling the title to it did not pass
