| Show THIEDE MUM > ER CASE Arguments Before the Territorial Supreme Court Yesterday OPMONS HATO > ED DOWN GAXXETT A7VD OGHAIB AITMCA TINS DENIED Seven Other Cases Tossed Upon William O JennIngs Apiialntea United States Commissioner to I Succeca Judge Ne7iallyThree Cnmlitlntcs Admitted to the Bar of the Snprcjno Coart Short Orders Or-ders I The territorial supreme court met I yesterday morning at 10 oclock After I some minor matters were disposed of I their honors listened to the arguments I on the application of Charles Thiede I under sentence to be hanged for the murder of his wife for a new trial A number of very important opinions were handed down and other matters attended to Arguments in the Thicilc CaseIn Case-In the Thiede case the arguments were made on behalf of Thiede by Judge Cherry and by Assistant District Attorney Howat for the prosecution Charles Thiede was tried In the Third district court on October 10 1894 on a charge of wilfully murdering his wife Mary just outside Thiedes saloon at Murray After a trial lasting ten days the jury found him guilty of murder in the first degree On Nov > 5 his counsel moved for a new trial and an arrest of judgment This was overruled and the prisoner sentenced to be hanged The appeal was argued today by Judge Cherry Cherry k Cherry on behalf be-half of the condemned man Assistant District Attorney Hewitt as at the trial of the case represented the prosecution prose-cution There are af great number of assignments assign-ments of error alleged on the part of the trial judge in his having allowed various incompetent witnesses to testify tes-tify in admitting the opinions of witnesses in excluding competent and legal evidence offered by the defertea during the trial in refusing to give certain cer-tain instructions to the jury on the request of the defense and in the final charge to the jpry On this last point a number of exceptions are taken One of the strongest points made however is that the court erred in permitting Louis Gronosky one of the twelve jurors ju-rors to be sworn and act as an interpreter inter-preter In the course of the trial for the witnesses Jacob and Mary Lauen berger Special stress is also laid upon the admission of the alleged Incompetent incom-petent evidence Judge Cherry contends con-tends that the prisoner did not have a fair trial at the hands of the prosecution prosecu-tion expresses the belief that Thiede Is innocent of the crime charged and that he has been illegally convicted Knowing says counsel that he had suffered intensely both from the cruel loss of his wife and the unjust and inhuman in-human charge laid at his door he has to insist that the trial court erred In overruling his motion Hence he asks for I reversal When the arguments closed the case was taken under advisement |
