representative yesterday is a voluminous affair and covers about a dozen typewritten pages I the complaint com-plaint the plaintiff states that it is the owner of the Silveropolis patented mil ing claim which lies alongside and au joins the Golden King mining claim pwned by the defendant company on the west hi which it alleges there is a lode of rock in place bearing gold silver sil-ver lead copper and other metals The complaint states further that the defendant de-fendant company i also the owner of the Bradley mining claim and goes onto on-to allege that within the past twelvemonths twelve-months the defendant has in working beneath the surface on the Golden I King and Bradley claims without the consent of the plaintiff and against the protest of the plaintiff unlawfully and wilfully driven drifts tunnels crosscuts cross-cuts and other underground openings It across the westerly side lines of the claims mentioned a belonging to the Mammoth company and into and beneath be-neath the surface of the Silveropolis claim belonging to the plaintiff The I plaintiff alleges further that the defendant de-fendant has mined and extracted a large amount of ore from the Silver opolis claim which it is informed and believes exceeds 600ft tons The value l j of the ore alleged to have been extracted ex-tracted is placed at a value of 50 a 1toh or an aggregate of 300000 for twhlch amount the plaintiff asks judgment judg-ment together with costs and such further fur-ther relief as justice requires in the premIses A s a second cause action the plaintiff plain-tiff alleges that the defendant threat I U ens to keep right on mining and extracting t ex-tracting ore from the Silveropolis claim and converting the proceeds therefrom to its own benefit unless restrained and enjoined by the order of the court ForHhis cause of action the plaintiff asks judgment and a decree of the court restraining and enjoining the defendant de-fendant or its manager agents or employees em-ployees from entering upon the said Silveropolis claim for the purpose of mining extracting or removing any ore or other material whatever on or beneath be-neath the surface of the said claim pending the trial of the case and upon J the flnal determination to be perpetu allv enjoined from so doing Sam Mcintyre was in Tintic yester dy where he is engaged in getting out shipments of ore
