Show BLAZER SCORCHED THE PUGNACIOUS JUSTICE FIXED FIFTY DOLLARS AND COSTS For His Assault Upon Fred MeGuririn Commissioner Greeiimims Review view of the Case Aot Ended YetI Yet-I Commissioner Greenman yesterday morning handed down his decision in the Blazer assault and battery case Blazer was fined 50 and at once gave I notice court of an appeal to the district In rendering judgment the court took occasion to administer a severe rebuke to the pugnacious justice of the peace who the commissioner declared had disgraced both himself and family through his brutal conduct His honor said that the law provided a fine not exceeding 300 or not exceeding exceed-ing six months imprisonment or both They all recognized the fact that the assault had been committed under circumstances assaul comiit cr cumstances through which it was more to be condemned and it had devolved de-volved upon the court to properly protect pro-tect its dignity While he did not wish to comment on the action of the court in imposing a fine of only 15 he thought it had not been sufficient He took into consideration the disparity in the ages of the two men and that the offense had been committed in the heat of passion but it had not been shown in evidence that the plaintiff had been in a position to defend himself him-self They were all subject to passions pas-sions but men who had reached the ages of himself and the defendant should have learned to control themselves them-selves The plaintiff had suffered irreparable irre-parable injury the defendant had also suffered not only physically but mentally men-tally He felt no doubt that he had disgraced himself and his family and he must certainly feel that he has lowered himself in the eyes of everybody every-body The court took all these things into consideration and the only interest inter-est he had in the case was to do what the law required of him He had come to the conclusion that while a strict vindication of the law might require him to send the defendant to prison he would only impose a sufficient fine as a warning to others I is said that Mr McGurrin contemplates contem-plates another flank movement in the matter |
