Show A VERY DRAMATIC CENE The Curtain Rung Down on theof f Van Patten Case J VERDICT OF THE JURORS THEY FIND THAT TilE DEFENDANT DEFEND-ANT IS INNOCENT It Tool Them Less Titan Halt nit Hour to Ilencli a Conclusion The Verdict JleetJ with General Approval Ap-proval In Prov o Cloning Scenes Prove March 30Mrs Emma Van Patten Is a free woman tonight and all Provo applauds the finding of the jury acquitting her of murder f It was 415 this afternoon when they E court delivered the charge and the jurors retired with the fate of the f woman in their hands It took them but > twentyfive minutes to reach an r i agreement The courtroom was packed t fi to suffocation when the jury filed in and the closing scene in this sensation f si case was intensely dramatic Mrs 4 Van Patten who had borne up wonderfully won-derfully under the strain of the past r few days showed considerable excite < ment as the end approached A hush fell upon the courtroom as the clerk arose to read the v drdUt nd all eyes were turned upon tha defehd t ant As the words Not guilty fell fc from the lips of the clerk Mrs Van k < Patten was visibly affected and the ji murmur that ran through the courtroom ly court-room was one of intense satisfaction i The lady was overwhelmed with congratulations con-gratulations The arguments in the case com mel ed in the First district court this morning at 930 oclock As usual the L jI courtroom was besieged and jammed to its utmost capacity and as the proceedings I t pro-ceedings neared their close the interest of the community increased w The general opinion seemed to be x iat a verdict of not guilty would be returned f Judge Jacob Johnson of Sanpete opened with an able argument for the prosecution He reviewed at length the evidence in the case and called up in detail the circumstances tending to incriminate the defendant Mr Houtz followed for the defense with a short but close logical and concise con-cise argument for the life and iberty of the accused Judge Dusenberry succeeded Mr e Houtz and called special attention to 1 the wife of the deceased her bad character char-acter and her conduct intimating strongly that she was the only one who had any motive in doing away with the deceased W H King concluded for the de fense and made a strong speech for the life and liberty of the defendant He claimed as he stated yesterday in opening the case that there was nothing noth-ing to implicate the defendant but that if any one was guilty it was the wife of the deceased District Attorney Thurman closed the case in a very able and telling manner man-ner marshalling the points against the defendant in a most effective manner r i The arguments throughout were able r and searching and lasted for about five hours At 415 the argumants closed c and Judge Smith charged the jury in a clear and intelligent manner dwelling > especially on the points relative to circumstantial cir-cumstantial evidence which cuts such m important figufe in this case The jury at once retired to determine whether or not Mrs Van Patten should go forth a free woman or as a con virted felon Then the defendant began to show evidences of the terrific strain she had been under and her face looked pale and wan In less than half an hour the jury returned re-turned with a verdict of not guilty asa as-a oYe stated |
