Show 45S WERE THICK I LEVI AYTELIS TRAGIC DESCEXT WON THE HOUSE OF HARVEY Armed with Two Big Guns He Starts Forth to Avenge His IiiiaKlunry Wrongs Bound Over l y Judge Xorrcll Smarting under wrongs he conceived had been done him on the occasion of his enforced retirement from the waterworks water-works department Levi Axtell made his way to the residence of exWater Master J H Harvey the other evening and but for the vigilance of the latter it is said a streak of daylight somewhat some-what crimson perhaps would have been let through him Yesterday morning at 10 oclock Ax tell was a prisoner before Commissioner Commis-sioner Norrell and this morning he is held in 1000 to appear before the grand jury on a charge of assault with a deadly weapon In the examination yesterday morning morn-ing there were a half dozen witnesses upon the stand Assistant County Attorney At-torney Eichnor appearing for the prosecution prose-cution and Judge Powers for the accused ac-cused The testimony after the complaining com-plaining witness J 11 Harvey his wife and two children Charles Turton and William Walker showed that on Vi1am the night the assault is said to have taken place Axtell and his son J W who was arrested with him made their appearance at the exwater masters door They were admitted when the 1 elder Axtell exclaimed 1 You discharged me and were hun 01 You can get something here replied re-plied Harvey At this juncture Axtell the elder who had both hands buried in the side pockets of an unweildy ulster flashed a revolver and was about to empty the deadly contents of its cylen dar in the complainant when the ex master by a quick movement grasped the weapon from his assailants hand and with the assistance of the latters I son ejected him amid the cries of his wife and daughter This testimony was corroborated by the remainder pf the household William Walker whose attention had been attracted by the disturbance walking up and leading Axtell away from the locality The codefendant young Axtell who had been unwillingly dragged into the tragic interview while attempting to induce his father to return home and go to bed testified that Axtell the elder had appeared at his dwelling the influence of liquor and under infuence lquor procuring pro-curing a brace of guns had started forth without stating his destination or his purpose The son made repeated but vain efforts to induce his father to surrender the ugly weapons to him and when the latter finally headed for the exwater masters he thought i simply a friendly visit With the consent of the prosecution the charge against young Axtell was dismissed and his father permitted to depart under bonds |
