Show BOYERS SAD STORY I HeWas Robbed of Ills Money While Hurrying to His Mothers I Funeral Mr Dan OBrien who Is charged with fleecing Phillip Boyer out of 120 as told I in yesterdays HERALD came up before Commissioner Greenman for trial yesterday I yester-day The case so far as the defendant is concerned con-cerned is a particularly sad one and so fart far-t as OBrien is concerned the chances are i very largely in favor of Captain Green i mans giving Judge Zane a chance to put tbe full extent of tho law upon him I Boyer is a poor FrenchCanadian who j has barely sufficient command of tho Eug lish language to make himself understood He has been living in California and a few days ago received the news that his mother was on her death bed Ho converted EVERYTHING THAT HE HAD into cash bought his tickets to Canada and with about 150 in his pocket started on his sad mission Boyors story is that OBrien and his confederates con-federates approached him on Wednesday on the Rio Grande Western train and engaged en-gaged him in conversation They found out his circumstances and that he had the money of which they afterwards robbed him and then proposed to play some game for stakes which werq to be returned Boyer acceded to a proposition that none but a poor educated foreigner would have entertained and when his money was all won he says that he asked OBrien te return re-turn i andthat smooth gentleman refused re-fused and telling him that he OBrien was a detective and threatened him with arrest The poor ignorant heartbroken chap having no friend near and no command of language submitted to this infamous piece of HEARTLESS ROBBERY and like a dumb steer went on his way until he was intercepted by the telegraph and brought back to testify against 0 Brien But the money is gone and all that remains re-mains to Boyer is the hollow satisfaction of sending OBrien to tho penitentiary 1 J Attorney iiicnnor in Denaii 01 isoyer I begged that ho might be allowed to make a statement and go on his sad mission as he only had 5 left from the robbers but Attorney At-torney Hammond who appears for OBrien insisted upon his legal rights and Captain Greenman was compelled to hold Boyer over as a witness until today but the captain cap-tain considerately made a compromised hour2 oclock It was stated that OBrien was visited in his cell by a number of sure thing men yesterday yes-terday and several of the officers and deputy marshals say that he is one of I them beyond all question of doubt When he comes up today at 2 oclock if such evidence is forthcoming he is in pretty good hands to got held good and hard |
