Show The City Enjoined An injunction was yesterday served on Mayo Armstrong enjoining the city to not offer for sal a certain lot as advertised The complaint Is i made by Thomas R Higgins and read follows fol-lows Plaintiff alleges that in ISoS one John White then a citizen of the United States and bona fide resident of the city of Salt Lake entered upon and took possession of a lot of land in this city known as lot 2 block 19 plat A containing 10 square rods That on the 6th day of August of said year last named Jesse W Fox who was then city surveyor sur-veyor for said I city executed and delivered to said White a certificate as follows Land certificate This is to certify that John White is the lawful claimant eliot 2 block 19 containing 10 square rods JESSE W Fox City Surveyor This certificate said White caused to be recorded re-corded Aug 13 18 as the law required That the said White held the undisturbed peaceable possession of said lot until about the 10th day of Oct ISeS when he sold and conveyed con-veyed all the right title and interest he had in the same to this plaintiff and this plaintiff at all times since said sale has been and is now In the possession of the same claiming and holding the same as his property That the said city l rtIake recognizes the right of the said plaintiff to the lot aforesaid afore-said assessed the same to him in the year 18S3foplxes at the value of 8205 and said plaintiff has paid said taxes t said city upon said lot and now holds a receipt therefor Plaintiff further alleges that In the execution of said conveyance by said White to him for said lot by mistake of the draughtsman the said plaintiff was nominated in said conveyance as he person conveying and the said White as the tS g ec person to whom the lot was conveyed but notwithstanding not-withstanding this mistake in the body the deed was duly acknowledged by the said Joins White as the grantor which was according to the facts P aintlff further alleges that the said White ffa J occupied and held said lot under the act of Congress Con-gress of the United States known as the Town site actond thatit is part of the land conveyed by the United States to the mayer of Salt Lake city under said Townsite act in trust for the occupants oc-cupants thereof and that the said White was the lawful and rightful occupant of the same at the time he conveyed I to the plaintiff Plaintiff alleges that notwithstanding all this said city of Salt Lake by its common council has assumed and claims to be the owner of said lot and now has the same advertised for sale for the 9th instant and although plaintiff has re 91 gt af g y applied to the said common council in the mat ter they have said to him that there is nothinl left for him but to bring suit to assert his rights Therefore plaintiff prays judgment IThat the said city be enjoined by prcliml nary injunction trom selling the plaintiff property prop-erty and thereby putting upon it a cloud 2That the plaintiff be decreed to be the rightful owner of said lot and that the mayor of said Salt Sake city be ordered by judgment by the court to make the plaintiff a deed for said lot 3And firally grant to plaintiff all such other urther different and general relief as the nature of this case may require or he may in the court of equity be entitled to SUTHERLAND i JUDD Attorneys for plaintiff The city officials were seen yesterday evening and they state that there is no lot offered for sale by the city that answers to the above descrip ton which applies to a lot on Seventh South and Third East streets There is however a let located in plat D In the Twentieth ward which is claimed by Mr Higgins and which was set apart from the sale at the last session of the definitely city council settled until the question of title hould be |
