Show ON TAKING THE OATH Five of the Mormons Summoned Sum-moned Subscribe CONSCIENTIOUS SCRUPLES Advanced by the Greater Portion Another Venire Returnable To day The reason for the summoning of members of tho Mormon faith on an open venire was revealed yesterday when it was learned that no more criminal crim-inal business WQuld receive the attention atten-tion of the court this term which ends on the third Monday in December next From now until that date civil suits only will occupy the attention of judge and jury Yesterday morning the venire was returned and the following gentlemen gentle-men answered to their names W H Rowe T R Ellerbe P W Madsen John RWinder Jr James Dwyer H B Clawaont Jr Alonzo Young Nelson Etnpey Daniel S Spence William L White C M Donelson Jr George F Brooks L S Hills John Druce R F Neslen George T Odell and Joshua Midgley Messrs Thomas G Webber and John A Groesbeck had also been served but had been excused L S Hills had been drawn as a petit juror within a year and thought that should oar him irom service this term The judge however did not see fit to release him on that account In answr to the query as to whether he had any other reasons to offer why he should not be compelled to servo he said he had none save that he did not want to take the oath prescribed That we will attend to after awhile said the judge Several smiles involuntarily flitted across the faces of the gentleman in watting to bs interrogated as Clerk McMillan read the monstrosity known as the political authorities oath which requtres jurors to swear that they will obey the laws of the United States prohibiting polygamy bigamy unlawful cohauitation incest adultery and fornication that tney will not hereafter at any time in obedience to any alleged revelation or to any counsel advice or command from any source whatever or under any circumstance circum-stance enter into plural or polygamous marriage or have or take more wives than one or cohabit with more than one woman contrary to said laws that they will not at any time hereafter directly di-rectly or indirectly aid or abet counselor counsel-or advise any person to have or take more wives than one or to cohabit with more than one woman or to commit com-mit incest adultery or fornication contrary con-trary to said laws that they are not bigamists or polygamists that they do not cohabit polygamously with persons of the other sex and that they have not been convicted of any of the offenses above mentioned Mr Rowe expressed himself as being prepared to take the dose Mr Ellerbecks face was an indication indica-tion that he did not relish the idea at all and when called upon for an answer an-swer he said I dont believe I want to take that oath Judge Zane informed him that his wants had nothing to do with the case The question was whether he could conscientiously subscribe to it Mr Ellerbeck in reply said he did not care to take ithe preferred not to If he did take it however he would keep itat least he would use his best endeavors in that direction The JudgeYou certainly should keep it it would be a good thing Can you conscientiously do so Mr Ellerbeck hardly know how to answer Court You cannot refuse to take it to avoid jury duty You can refuse if you cannot take it conscientiously Mr Ellerbeck dont think I will I will not take it The CourtYou are excused Mr Winder had no objections to offer and he was accepted Mr Madsen thought he would rather not take it he did not know about tho future but so far as the present tme was concerned he thought he could take it and keep it The CourtIf you can take it today you had better do so If you take it of course you must ktep it Mr MadsenWell I do not believe I will take itT it-T he Court Yu say you cannot conscientiously con-scientiously take it Mr M ad senNo I dont say that I dont know about keeping it The Court Well Mr Madsen if you can conscientously subscribe to it today to-day you should do so It was swallowed Joseph A Jennings had no objection to takiifg the oath and was gathered in James Dwyer declined to subscribe saying thatjhe could not conscientiously do so i H B Clawson at first said he could take it but after some reflection declined I de-clined and was excused Robert F Neslen said he could take it up to date but if hewas to be selected select-ed as a juror he would be compelled to close his store as he had no one who could attend to business during his absence He was willirg to do the government any service but in this case his bread and butter was at stake This was satisfactory and he was released re-leased George T Odell was willing to take the oath and was passed The following were excused because of their having c scientious scruples Alonzo Young D S Spencer W A Empev C M Donelson Jr W L White George F Brooks John Druce and Joshua Midgley Another venire of twelve names was ordered to be returned tomorrow |
