Show BISHOP UDALL I The conviction of Bishop David K i Udall of St Johns Arizona perjury as reported in THE HERALD a few days ago seems to have been the result of malice on the part of the judge prosecuting prose-cuting attorney and jury The alleged Perjury was committed in the United States land office at Prescott where Bishop Udall appeared as a witness in the provingup of a land entry Udall I explained to the clerk in the office that ie > could not answer yes to certain questions out explained to what extent his absolute knowledge of the facts went The clerk said that the knowledge was sufficient and that it would hot be improper im-proper to answer yes which Udall thereupon did He was then indicted and tried Sumner Howard being the judge The jury was selected because of its pronounced hatred of Mormons and the judge as a matter of course denied to the accused every right and privilege that could be withheld Under the circumstances conviction was cer tain Udall was sentenced to three years in the Detroit House of Correction and rushed off east before his wife and friends had an opportunity op-portunity to even bid him goodbye While his offiense was technically perjury per-jury he was convicted because he was a Mormon the offense of which he was guilty is committed every day in the average land office and nothing is thought of it nor is anything done I about it Howard and his pals have long been trying to get their hands on Udall and now that they have succeeded suc-ceeded they are highly pleased Many of the nonMormons in and about St Johns denounce the convic tion as a cruel outrage and > it is said that some of them are moving in the matter of trying to obtain a pardon for the Bishop who seems to enjoy the con deuce and respect of the better elEment of the Apache County community |
