Bullock E 0 Haymond Nelson Bailey and Sydney Bailey The testimony began Monday morning morn-ing tJ i JFrederick W Chappell swora for the prosecution He was Justice of the peace at Nephi and acting coroner at the time of the murder of Forrest Grean on the 10th of January 1335 he examined the body they removed it to the salotin bf Abe Chalmers WAll the witnesses save the oneninder examination were excluded from the courtroom Mr Chappell said they examined the body i saw the bullet hole J I in the body somewHere jnear the heart Ernest Green was swornHe identified identi-fied the body he first met Mr Pearson in Colorado Forrest Green was his brother bro-ther the defendant and my brother were on good terms when I lefc them between Dog Valley and Nephi they went toN to-N ephi on business they told me the first I next saw of my brother was his body laid out in the court house at Nephi W P Boeman sworn Lived in Nephi saw the defendant at Chalmers salopn at 4 pm January 10th 1885 S when I first saw him he had a knife and pistol in hishand he said Green this knife and pistol were made to kill yon 1 spared your life once but will never do it again Pearson then I went to where the animals were standing I stand-ing Mr Gadd and Mr Green then followed fol-lowed Mr Pearson then told him Green to stop Green went on Pearson Pear-son pulled his pistol and told him to stop or he would kill him Green then went to the head of the horses Pearson said Stop Gd dn you or Ill kill youn Green then answered Kill me if you want to Pearson said Look out it is full cocked if you dont stop Ill kill you Pearson then said Well G 7 d you I will kill youand fired Mr Green staggered and fell Mr Pearson told Gadd to turn the body over He then told some one to stop his horses Mr Painter stopped them He told Gadd if he didnt turn the body over he would kill him Mr Boreman said they went to Mr ChKlmers to get a gun and go to arrest Pearson Pearson told me tdget out of the way I then sent a coy to the sheriff to notify him I helped to get the body into the saloon and helped to wash it Mr Painter helped to wash the body also I was at the examination I examina-tion next morning The examination was partly gone through with and adjourned till Tuesday Tues-day S TUESDAY Jas Hartly Was bar tender at Juab saw the defendant drink alcohol I punch and veral times whisky he also took from the saloon two bottles of beer Green pulled off his coat i there appeared to be a storm brewing there some trouble over some money that had dropped on the floor immediately after Green pulled off his coat they went out of the saloon Mr Pearson went out and told Green lie was going Green followed Pearson out Gad and Hardy soon followed the former to take Greens coat to him They went out to the yard where their horses were and had some conversation Green and Pearson had some words at the door as they went out Mr Green offered Pearson his choice of weapons Pearson had his knife in his belt Mr Pearson said he had given Green his life once A knife was offered toGreen and he would not take it Pearson had reached the horses and Green reached them soon after Pearson Pear-son said Come on lets go Pearson Pear-son was about fifteen feet away from Green and told him not to advance nIr Pearson had a pistol in his hand it was down at his side the next position posi-tion was he held it up and told Green to stop or he would shoot him Green was then about six feet away Green hesitated a moment or so he then made an effort to go towards Pearson when the later fired the shot I saw the man shoot they were pretty close together about six or seven feet 1 hedrd the report and saw the fire of the pistol Green fell over I was about seventy feet away Green said Xouve killed me Pearson asked Gadd if he Pearson had hit him Pearson then held the gun on Gadd and told him to look and see if Green was hit Pearson then said Get out of the way boys I am going his horse was a little distance from Greens body i Pearson went up to get on it I saw Pearson get on his horse he had his uitol in his hand when he mounted his horse ad kept it until out of sight down the street I found the body still breathing there was Bore man Painter and myself who went up to the body it ceased to breathe in a little while before I left In my judgment judg-ment it was about ten minutes after the firing of the shot until he ceased to breathe I think the pistol was a 44 Colt revolver Pearsons knife was about six inches in the blade with a thick back One ot the jurors asked the question You say Mr Pearson fiqurishedhis pistol pis-tol in Greens face whilein the b room r-oom Yes > sir tint he only seemed to takev it as a joke 5 The case is progressing very slowly I only three witnesse being examined so
