Show I LATEST T LE tBAHS XLYH CONGRESS II REGULAR SESSION HOUUE Washington 3The House resumed re-sumed consideration of the Ala bama contested election case Wheelei being accorded the floor to close the aigument in his own behalf be-half At the conclusion of the argument argu-ment he yielded to Springer who contended that if Lowe was to be seated it would be upon tissue ballots bal-lots and he gave notice that he would offer a resolution recommitting recommit-ting the case and instructing the committee to ascertain the number of tissue ballots cast for either party and to report who was elected after rejecting such ballots Hazelton demanded the previous question pending which Springer moved to recommit with instructions instruc-tions and placed that motion in the form of a resolution and preamble The preamble sets forth that the number of socalled depositions offered by contestant were never I certified and did not show that any of the pretended witnesses were sworn in and that some of the depositions had been changed since the examination At this point Reed objected to further reading claiming the preamble pre-amble was merely a speech and made the point of order that it was not proper t9 be incorporated in a motion to recommit In arguing his point of order he stated that the allegations in the preamble were untrue and that the resolution had come in under false pretenses inasmuch inas-much as the gentleman from Illinois had merely given notice that he would more to recommit with instructions in-structions Randall said it was due to the gentleman from Illinois Springer to state that the preamble was not drawn up by him but was placed in his charge after he had concluded his speech Springer declared that he had acted in perfect good faith and that if the gentleman from Maine Reed insisted to the contrary he was acting without the slightest foundation If he were the honorable gentleman that he Springer always regarded him he would in the face of the House and the country withdraw the intimation intima-tion of bad faith and falsehood did he do so I Reed He does not I SpringerThen I state that the gentleman takes chances of ding I what no honorable gentleman should doimputing bad motives and false motives to another member mem-ber ReedI am ready to take it The Speaker ruled the resolution was not in order on the ground that portions of the preamble were in the nature of debate Springer was successful however in getting the whole preamble in the Record by appealing from the decision of the chair The appeal was laid on the table Springer then moved to recommit with instructions in-structions to the committee to ascertain as-certain the number of tissue ballots cast for either Lowe or 1 heeler and to report a resolution giving the seat to the one having the highest number of legal votes after reje ting t-ing all sueh tissue ballots The motion was lost 7 yeas 91 nays 132party vote except Smith New York who voted with the republicans The previous question was then ordered without devislon Hazelton closed the debate with an hours speech in favor of the contestant The resolution declaring declar-ing the contestant entitled to his seat was adoptedyeas149 nays 3 and Lowe appeared at the bar of the House and took the oath of office On motion of Springer the senate joint resolution passed for printing the memorial address of James F Blain upon the life and character of the late President Garfield Adjourned |
