| Show Third District Court Proceedings in the Third District Court on Thursday Chief Justice Hunter presiding In the case of George Loney vs James Dinwoody administrator etc the demurrer of defendant to the amended complaint was generally gener-ally overruled Defendant was allowed lowed to answer on payment of clerks costs The motion of defendants to discharge dis-charge the attachment was allowed in the case of Steele Johnson Co vs Arthur A Needham et al The demurrer to the amended complaint was sustained in the case of Rasmussen et al vs James Mc knight et al and leave to reamend the complaint was granted In the case of M Hirschman vs Flagstaff Silver Mining Company the original summons was served on M C Vincent who was not the authorized agent of the company and the court held the service was void and quashed the service ser-vice Subsequently plaintiff asked leave to withdraw the summons for further service and it was then properly served on C K Gilchrist Esq The defendant moved that this latter service be quashed on the ground that the proceeding was improper and that an alias summons should have been asked for The court overruled the motion and held the service on Gilchrist good Leave to answer on the 20ti of January was granted A motion for judgment on the pleadings in the case of W S Mc Comic vs C T Marsden was sustained sus-tained nnd defendeuc allowed time to answer The demurrer to the complaint was sustained in the case of Solomon Solo-mon Lebees vs B W Driggs and plaintiff was allowed fifteen days time to amend his complaint In the case of Alex Le Clair vs A C Pyper etc the court dismissed dis-missed the mandamus proceedings by reason of the death of re pondent Court adjourned till 10 oclock tomorrow to-morrow morning |
