Show I FOLLOWING is the text of the petition pe-tition of Hon John r Caine for a seat in the Fortyseventh Congress as delegate from this territory It will be remembered the petition was referred to the committee on elections and afterwards to a subcommittee sub-committee of that committee since which nothing has been heard here from it It is probable there will be an early report and not at all unlikely the report will be in favor of Mr Caine taking the sea > which belongs to this territory The petition of the undersigned respectfully re-spectfully shows that he is the delegate elected for the territory of Utah for the Fortyeighth Congress s That at the lat session of tee present Congress the seat of delegate for said territory ter-ritory to the Fortyseventh Congress was declared vacant and the people of old territory are DOW unrepresented Prior to the election held on the first Monday in November 1882 the governor gov-ernor of said territory was requested to call an election to elect a delegate fVr raid territory fr the unexpired term of the Fortyseventh Congress and refused on the ground that be had no power in that respect A like request was made to the commissioners com-missioners ol elections for said territory appointed by the President of the United States under what is known as the Ed munds bill and they refused on the Eameground At the election hell November 7 1882 to elect a delegate to the Forty eighth Congress yonr petitioner received 15490 votes for the office of delegate for the unexpired term of the FortyEeventh Congress and to fill the vacancy existing exist-ing m said office The commissioners of elections for said territory as will appear from a copy of their instructions annexed refused to canvass allow said votes to be officially canvassed or an facial return thereof made on the ground that their power did not extend to that subject The number of votes so cast and the fact that the voting for delegate to fill said vacancy was quite general throughout through-out the territory will appear from the affidavits of precinct judges of election and a summary thereof hereto annexed Inasmuch as the people of said territory terri-tory are entitled to representation in your honorable body and under the construction con-struction of the law by the governor and commissioners there seems to be no way provided for calling such an election your petitioner submits that the voluntary volun-tary and general expression of the will of the people through the billotbox is the best and only obtainable manner of filling said vacancy and requests that he may be declared entitled to a seat as delegate del-egate for said territory for the unexpired term of the Fortyseventh Congress |
