Show BRIGHAM YOUNGS ESTATE A Slice of It Claimed by the Cummings Family The Complaint as Filed Yesterday Yes-terday The following suit was entered in the Third District Court yesterday by the family of James W Cummings Cum-mings against the executors of the last will and teotament of the late President Brigham Young In the Third District Court Utah Territory County of Salt Lake COMPLAINT Annette Cummings 1 L A Cummmge I H L Cummings J Plaintiffs Ernest M Cummings I Annabella Cummings J versus Brigham Young Albert Carrington t Defendants George Q Cannon J Executors of the last will and testament testa-ment of Brigham Young deceased The plaintiffs complain and allege 1 That the plaintiff Annette Oummings is the surviving wife and that the other plaintiffs are the children of James V7 CummingSj I deceased and that they are therefore there-fore the lawful heIrs of the said James W Cummings 2 That the defendants are the duly appointed and qualified executors I execu-tors of the last will and testament Brigham Young deceased 3 That the said James W Cummings Cum-mings deceased up to the 6th day of June 1877 and for at least ten years prior thereto was and is still the owner in fee simple and law folly entitled to tha possession of the following described piece or parcel of land to wit the southwest quarter of section 22 in township one south of range one east of the Salt Lake meridian being be-ing situated in Salt Lake County Utah Territory his title to the said land being a United States patent for the same issued to him on the 15th day of July 1872 saId patent having never been revoked cancelled cancel-led nor eet aside 4 That on the said 6th day of June 1877 one Brigham Young deceased de-ceased as aforesaid wrongfully entered en-tered upon and took possession of the said premises and retained the same until his deathwhich occurred August 29th 1877 and the said property is now held detained and used and has been eo held detained and used from tho last mentioned date by the defendants herein executors exe-cutors as aforesaid and by persons whom said defendants have placed in the possession thereof it being now to plaintiffs best information and belief held detained and used by Agnes M Young the widow of M M Young deceased with the Knowledge and consent of the defendants herein whereby the plaintiffs are and have been for nearly seven years last past deprived de-prived of all benefits and uses accruing ac-cruing from the said property and from the posEession thereof 5 That a demand ha been made on the defendants by the plaintiffs herein for the restoration to the plaintiffs of the said property that said demand was refused whereby plaintiffs are greatly injured in-jured and have sustained damage by reason of such wrongful occupation occupa-tion and detention in the BUm of SlJOOO Wherefore plaintiffs pray for a decreeof this court awarding to them the said property with the improvements thereon for damages in the sum of 14000 for their costs herein and for such other and farther relief as to this court may be deemed adequate equitable and just DARKE L KENNER I Attorneys fur Plaintiffs L A Gumming being duly sworn on his oath says I am one of the plaintiffs in the above entitled enti-tled action I have heard read the above and foreerolncr nomnlaint and know the contents thereof and the same is true of my own knowledge except as to the matters and things therein stated on information and belief and as to those things I te lieve it to be true Signed L A CUMMINGs Sworn to and subscribed before me this 31st day of Mays 1884 War FULLEB Notary Public |
