However, if the weather remains warm the District will continue to serve irrigation water sometime after 15 October. Water users should check their individual system and be prepared to open drain valves and drain their lines to prevent freezing after the water is drained from the main lines. VAN L. HANSEN State Engineer Published in the Davis County Clipper First publication Oct. 13, 1978 Last publication Oct. 27, 1978 C-319 ORDINANCE NO. 78-15 BOUNTIFUL, a Municipal Corporation AN ORDINANCE AMENDING AMEND-ING TITLE XIII, CHAPTER 1, SECTION 55, OF THE REVISED ORDINANCES OF BOUNTIFUL UTAH 1965 AS AMENDED, BY SPECIFYING SPECIFY-ING MAXIMUM SPEED LIMITS ON ALL STREETS IN BOUNTIFUL, UTAH, AND REPEALING ALL ORDINANCES OR-DINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF BOUNTIFUL, BOUN-TIFUL, UTAH: Section 1. Preamble. The City Council of Bountiful, Utah deems that in order to preserve the peace, health, safety and welfare of the City of Bountiful, that the maximum speed limits be as specified in this ordinance. Section 2. Statement of Findings. The City Council determines upon the basis of an engineering and traffic investigation that the prima facie speed limits on all streets in the City of Bountiful be, as specified in this ordinance. or-dinance. Section 3. That Title XIII, Chapter 1, Section 55, of the Revised Ordinances of Bountiful, Boun-tiful, Utah 1965, as amended, be amended to read as follows: Section 13-1-55. SPEED LIMIT (1) No person shall drive a vehicle on a street at a speed greater than is reasonable and prudent under the conditions, and having regard to the actual potential hazards then existing. In every event, speed shall be so controlled con-trolled as may be necessary neces-sary to avoid colliding with any person, vehicle, or other conveyance on or entering the highway in compliance with the legal requirements and the duty of all persons to use due care. (2) Where no special hazard exists the following speeds, as specified in this section, shall be lawful, but any speed in excess of said limits shall be prima facie evidence that the speed is not reasonable or prudent and that it is unlawful. (3) 20 miles per hour. When passing a school building or grounds thereof during school, recess, or while children are going to or leaving school during opening or closing hours, or when passing through a designated desig-nated school crossing zone, no person shall drive a vehicle in excess of 20 miles per hour. (4) Posted speed limits. On all streets where the speed limit is posted, such speed limit shall be as posted. (5) 25 miles per hour. Except as posted or otherwise other-wise provided, the prima facie speed limit on all streets and all places shall be 25 miles per hour. Section 4. Conflict. All ordinances, or-dinances, resolutions and orders or parts thereof in conflict with the provisions of this ordinance, are to the extent ex-tent of such conflict hereby repealed, provided however, that such repeal shall not effect ef-fect any act done, or right accrued, and any penalty incurred, in-curred, any suit, prosecution, or proceeding pending. Section 5. Effective Date. In the opinion of the City Council of Bountiful, it is necessary for the immediate preservation preserva-tion of the peace, health and safety of the inhabitants of Bountiful that this ordinance take effect immediately upon first publication. No. 32008 (31-418) owned by Bountiful Water Subconservancy District, 385 West 500 South, Bountiful, Utah 84010 covering 25 cfs. of water to be divertea irom Stone Creek and used for irrigation purposes. It is represented that at this time there has been no attempt at-tempt to introduce the Stone Creek water into the pressurized pres-surized system of the District. In the future, a decision will be made as to the expense and feasibility of introducing the water into the pipeline. Additional Addi-tional time is needed to complete the project and make and submit proof of appropriation. Appl. No. 35462 (31-2755) owned by Parson Asphalt Products, Inc. P.O. Box 3308, Ogden, Utah 84403 covering 0.015 cfs. of underground water to be diverted from an 8-inch well and used for domestic purposes. It is represented that zoning changes have made it impossible impos-sible for this development to proceed at this time. In the event this property is not utilized as a sand and gravel pit, it will be developed into housing. Additional time is needed to complete the project and make and submit proof of appropriation. Protests resisting the granting of these applications with reasons thereof must be filed in duplicate with the Sute Engineer 200 Empire Building, 321 East 400 South, Salt Lake City, Utah 84111, on or before November 25, 1978.
