Mr. Hendrickson says it was answered in the affirmative. At this point counsel for the defendants asked that the record show that the witness wit-ness hesitated about twenty seconds, j Counsel for the plaintiff expressed wllling-' wllling-' ness that it might show thirty seconds of I hesitancy. Under cross-examination Mr. "Woods ; admitted that he had heard Mr. Funk testify. Neither witness would admit, however, that he had gone through any process of refreshing his memory. Woods said that he had not thought much about it since the meeting, but that he and others had lantrhfirf jihont it considerably immediately after the meeting. Counsel for the defendants won from one of the witnesses of the day, Abraham Jorgensen, admission that he had regarded re-garded the enterprise for a factory as abandoned after the site west of Smith-field Smith-field was given up. He said he had said as much to Mrs. Hendrickson, wife of the defendant. Three witnesses subpenaed for the day that he had ever heard Mr. Hendrickson Hendrick-son say he had abandoned the enterprise. enter-prise. Other witnesses who testified were H. J. Fredrick, J. E. Greaves, A. F. Elggren and Elias Larson.
