Show CONSTITUTIONAL AMENDMENT A JOINT RESOLUTION PRO-PROSING PRO-PROSING TO AMEND ARTICLE 1, SECTION 13 OF THE CONSTITUTION CON-STITUTION OF THE STATE OF UTAH, RELATING TO PROSECUTION PROSE-CUTION BY INFORMATION OR INDICTMENT AND TO GRAND JURIES. Be it resolved by the Legislature of the State of Utah, two-thirds of all members elected to each of the two houses voting in favor thereof : Section 1. It is proposed to amend Article 1, Section 13 of the Constitution of the State of Utah to read: Section 13. Offenses heretofore required to be prosecuted by indictment, in-dictment, shall be prosecuted by information after examination and commitment by a magistrate, unless un-less the examination be waived by the accused with the consent of the State, or by Indictment, with or without such examination and commitment. The formation of the grand jury and the powers and duties thereof shall be as prescribed pre-scribed by the Legislature. Section 2. The" Secretary of State is directed to submit the proposed amendment to the electors elec-tors of the State of Utah at the next general election in the manner man-ner as provided for by Article 23, Section 1, Constitution of Utah. Section 3. If adopted by the electors of this state, this amendment amend-ment shall take effect the first day of January, 1949.
