The matter was referred to the citys planning commission. Previously, the council passed a new city ordinance raising the business license fee for transient merchants from $10 per day to $50 per day. .Greg Lee, who wants to put a snow cone station up at the Five Points Mall, said he couldnt understand why the fee was so high. In talking to city officials, he said he discovered it was felt the city passed the higher fee to discourage ht businesses from coming to the city. I would hope that you would consider me a step above that, Lee said. Lee said the shack would be fully safe and contained. He said he has received permission to locate one in the Five Points Mall parking lot for four months during the spring and summer months. We have a pretty good track record. Councilman Bob Linnell sug- gested the city grant a variance to snow cone shacks. But City Attorney Layne Forbes said that legally it may be con- sidered discrimination to grant a variance for one type of temporary business, while not granting the same variance for other similar businesses. Forbes also said a distinction would need to be made by the city between such businesses as cheese trucks that were on wheels and those that were and others. Lee said his business would not open until May, but that he needed to know what direction the council would take soon so he could firm up a lease. He said he may locate one or two other snow cone outlets in the city also. The Weber Basin Water Conservancy District will pay $25,000 more than expected for work done on a well project in Riverdale. In a decision, with Board 5-- 4 President Frank W. Bohman casting the tiebreaking vote, the districts board of directors decided to pay the extra fee if James M. Montgomery Engineers, the company that did the work, can verify the amount of money and time spent on the project. Original estimates on the project for engineering consulting fees was $15,000, but because the firm was unsure of the scope of the project, and because of an erroneous low estimate, the cost to the firm was $45,000, according to Kent Jones, Ogden office manager for the company. The engineering firm estimated that it would cost $5,000 for work on a pump station for the well. That estimate should have been between $20,000 and $30,000, said Jones. The engineering company claimed the well contract was based on an hourly rate and projects esti could exceed the B mate. District Manager Keith G. Jensen said he felt the district had no obligation to pay the extra money when he was first approached with the problem. But, he said, he has been advised that the contract is based an hourly rate and had changed his mind. Board Members expressed their concern that cost overruns on the project were not reported to the districts management. Jones explained that his firm had another contract with the district, a lump sum agreement with the district for $88,000 for the design phase of transmission lines from the well site.
