Show COMBINED NOTICE FONSI-NOIRROF Finding of No Significant Impact and Notice of Intent to Request Release of Funds Date: January 13, 1988 Centerville City Corporation, 521 North 400 West, Centerville, Utah 84014 (801) 295-3477 TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS; On or about January 28, 1988, the above named City will request the Utah Division of Community Development to release funds provided under Title I of the Housing Hous-ing and Community Development Act of 1974, as amended (PL 93-383) for the following fol-lowing project: Centerville Fire Station, Land Acquisition, Acquisi-tion, Centerville, Davis county, Utah FINDING OK NO SIGNIFICANT IMPACT It has been determined that such request re-quest for release of funds will not constitute consti-tute an action significantly affecting the quality of the human environment and accordingly the above named City has decided de-cided not to prepare an Environmental Impact Statement under the National Environmental En-vironmental Policy Act of 1969 (PL 91-190). 91-190). The reasons for such decision not to prepare pre-pare such Statement is as follows: An environmental assessment was completed and except for history, no mitigation miti-gation actions were necessary. All procedures proce-dures and requirements established by the Division of State History and the Advisory Advis-ory Council on Historic Preservation have been complied with. Other than the Environmental En-vironmental Assessment, no other documentation is deemed necessary. . An Environmental Review Record documenting review of all project activities activi-ties in respect to impacts on the environment environ-ment has been made by the above-named City. This Environmental Review Record is on tile at the above address and is available avail-able for public examination and copying upon request between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. No further environmental review of such project is proposed to be conducted prior to the request for release of CDBG project funds. PUBLIC COMMENTS ON FINDINGS All interested agencies, groups and persons per-sons disagreeing with this decision are invited in-vited to submit written comments for consideration con-sideration by the City to the Office of the Undersigned on or before January 28, 1988. All such comments so received will be considered and the City will not request release of funds or take any administrative action on the project prior to the date specified spe-cified in the preceding sentence. RELEASE OF FUNDS Centerville City Corporation will undertake the project described above with CDBG funds provided by the Utah division of Community Development (DCD) under Title I of the Housing and Community Development Act of 1974, as amended. Centerville City Corporation is certifying to DCD that Centerville City .Corporation and Dean C. Argyle in his official capacity as Mayor consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to environmental environmen-tal reviews, decision making and action; and that these reponsibilities have been satisfied. The legal effect of the certification certifica-tion is that upon its approval, Centerville City Corporation may use the CDBG funds and DCD will have satisfied its re-. re-. , sponsibilities under the National Environ-. Environ-. ital Policy Act of 1969.' OBJECTIONS TO STATE s RELEASE OF FUNDS DCD will accept an objection to its approval only if it is on one of the following follow-ing bases: (a) that the certification was not in fact executed by the certifying officer or other officer of applicant approved by DCD or (b) that the applicant's environmental environ-mental review record for the project indicates indi-cates omission of a required decision, finding or step applicable to the project in the environmental review process. Objec- tions must be prepared and submitted in accordance with the required procedures (24 CFR 58) and may be addressed to: CDBG Program, Division of Community Development, 6233 State Office Building, Salt Lake City, Utah 84114. Objections to the release of funds on bases other than those stated above will not be considered by the Division of Community Com-munity Development. No objection received re-ceived after February 13, 1988, will be considered by the Division of Community Development. . DAVID A.
