Mr. Gunderson. through his attorney, L. A. McGee. claims that errors were made in W'n-ter W'n-ter Quarters, Castle Gate, Helper. Price. Wellington, Sunnyside, Clear Creek, Kenilworth, Hiawatha, Storrs and Standardville. The contention of the contestant is the same as that explained recently in the News-Advocate in the contest of Eugene San-tschi San-tschi for the two-year commissioner-ship. commissioner-ship. The claim is made .that on many ballots on which a cross wis placed in the circle 'Underneath the Democratic emblem and a cros wap also placed opposite the name of Gunderson, the name of Bryner was not. crossed out and the ballots were counted for Bryner. It is also contended con-tended that on many ballots where the cross was placed in the circle un. rler the Republican emblem and a cross was placed opposite the name of Bryner in the Democratic column! without, scratching the name of Gun derson, the vote was also counted for Bryner. Thisi the contestant claims is contrary to statute because it is provided that where a voter wishes to place his mark in the circle underneath under-neath the party emblem and then wishes to vote for one or more on smother ticket he must not only mar a cross In the square opposite the name of those for whom he wishes to vote on the other ticket but must scratch out the names of the candidates candi-dates on his own ticket for those off. ces. Smith, Democratic candidate for county clerk, has also filed a petition pe-tition demanding that the certificate of election' of Ernest Horsley be cancelled can-celled and a certificate be issued to him.
