Briscoe' was certain, cer-tain, he thought, that his helper had come to his aid on a bicycle, while-the man himself said that he went afoot. The testimony tes-timony of the aged roan was also at conflict con-flict in other points, and Judge Dlehl held ..that there was not sufficient evidence before be-fore the court to warrant holding Beard for trial in the District court.
