A verdict has been rendered In favor of the plaintiff In tho libel suit brought ngnlnst tho Ladles' Homo Journnl (published by tho Curtis Publishing Pub-lishing Co.) by the World's Dispensary Dis-pensary Medical Association, ot which Dr. It. V. Pierce Is president. Tho suit was brought by Doctor Pierce against the Curtis Publishing Co., for making fatso statements nbout ono of his standard family medicines known ns Dr. Plerco's Favorlto Prescription. Pre-scription. In the May number ot the Ladles' Homo Journal (1904), Mr. Edward Ed-ward Dok. tho editor, stated that Dr. Pierce's Fnvorlto Prescription con-, tnlncd alcohol lind somo other harmful harm-ful Ingredients, nnd Dr. Plcrco had In tho action alleged that tho defendant defend-ant maliciously published this nrtlclo contnlnlng such fnlso nnd defamatory matter. Dr. Plcrco further claimed that no nlcohol Is or over was contained con-tained In his "Favorite Prescription." thnt said medicine was a vegetable preparation and contained no deleterious dele-terious Ingredients whntcver; thnt Mr. Hole's statement, pretending to give somo of tho ingredients of said medicine, medi-cine, was wholly and absolutely rabio. During tho trial, tho Vice-President Vice-President of the World's Dispensary Medical Association stntcd, that tho Ingredients ot Dr. Pierce's Fnvorlto Prescription wero extracted rrom tho following nntlvo roots: Golden Seal, Blue Cohosh, Lady's Slipper, Black Cohosh and Unicorn, by means of pure glycerine. Ho wns asked how he knew, ns n physician and experienced ex-perienced medical man, that tho "Favorlto "Fa-vorlto Prescription" "Was a cure for tho diseases peculiar to women, such as amenorrhea, dysmenorrhea, onto-version onto-version rotro-vcrslon, and ho stated '.hat ho knew such was tho tact be-:auso be-:auso ot his professional experience ind tho many thousands ot womon ivlioso Ills had been cured by this "Prescription." Tho Vice-President, being asked to glvo his authorities, rend from tho standard works, such as tho United States Dispensatory, Tho Amorlcnn Dispensatory and many other otandard medical books. Tho retraction printed by tho Cut-tls Cut-tls Publishing Company two months after the libelous statement appeared and nearly two months atter the suit had been begun stated definitely that analyses had been made at their request re-quest and that tho "Favorlto Proscription" Proscrip-tion" did not contain cither alcohol, opium or digitalis. |
