Any persons who misrepresents misrep-resents the cost of parts or presents pre-sents the cost of parts not directly related to the reason or reasons for motor vehicle inspection failure shall violate this ordinance and be subject to criminal penalties. 4. During reinspection the inspector-mechanic shall determine de-termine whether the parts installed in-stalled by any person not an inspector-mechanic were to correct problems directly related re-lated to the reason or reasons for test failure of the motor vehicle. If the parts installed were to correct problems directly related to the reason or reasons for test failure, the costs shall be credited toward the maximum repair cost provided pro-vided for in Section XXI. D. Any motor vehicle must be repaired to the full extent of any warranties related to emission emis-sion devices, equipment or systems before any repair costs can be used as a credit toward the maximum costs provided for in Section XXI. SECTION XIV REINSPECTION OF MOTOR VEHICLES FAILING TO COMPLY WITH EMISSION LEVELS EN SECTION XV A. Reinspection of motor vehicles by inspector-mechanics: inspector-mechanics: After repairs are made, the motor vehicle shall be retested in accordance with Section XII(C) recording the results on the inspection report. re-port. 1. If the motor vehicle retest results are determined not to meet the test standards provided pro-vided by Section XV, and subject sub-ject to the provisions of Section Sec-tion XIII. If the repair costs exceed the maximum amount established estab-lished in Section XXI and the motor vehicle has not been tampered with the inspector-mechanic inspector-mechanic shall complete the inspection report and issue the Certificate of Compliance. b. If tampering has occurred on the motor vehicle, either the tampering must be rectified or other repairs made until the motor vehicle passes the requirements re-quirements of SECTION XV. SECTION XV TEST STANDARDS A. SECTION XVII DATA COLLECTION AND EVALUATION A. Statistical Analyses: The Division shall conduct ongoing statistical analyses of the operation oper-ation of the inspection program. prog-ram. Statistics may be compiled com-piled on the basis of random sampling or full population stu-dies, stu-dies, as the Division finds necessary, and shall include but need not be limited to collection col-lection and evaluation of data on the following factors and their interrelationships: 1 . Number of motor vehicles inspected. 2. Number of motor vehicles initially passing or failing. 3. Number of motor vehicles reinspected for each sequential sequen-tial reinspection. 4. Number of motor vehicles passing or failing each sequential sequen-tial reinspection. 5. Number of Certificates of Compliance issued under compliance. com-pliance. 6. Number of Certificates of Compliance issued under waiver. 7. Number of motorvehicles subject to the inspection requirement re-quirement which are not subject sub-ject to the registration requirement require-ment (e.g., publicly-owned vehicles). 8. Dates and locations of inspections. in-spections. 9. Motor vehicle mileage readings upon inspection. 10. HC and CO emission levels. 1 1 . Motor vehicle characteristics, character-istics, including numbers of cylinders, make, model years, vehicle license numbers and vehicle identification numbers. num-bers. 12. Program Report: The Division Di-vision shall annually report to the County Commission on the inspection program. A complimentary com-plimentary annual report will also be presented to the Davis County Board of Health. SECTION XVIII PENALTIES FOR V IOLATIONS A. Any violations of the provisions pro-visions of this ordinance shall constitute a Class B misdemeanor. misde-meanor. B. Any violation of this ordinance ordi-nance by an inspector-mechanic inspector-mechanic and-or an operator of an inspection station shall authorize the Division to suspend sus-pend or revoke the permit of the inspector-mechanic and-or the inspection station. C. Upon suspension of revocation re-vocation of a permit, hearings may be held in accordance with Seciton X of this ordinance. ordi-nance. D. Multiple Violations: In the case of multiple violations considered at one time, the Division Di-vision may impose separate penalties for each violation. E. Voluntary Discontinuance: Discon-tinuance: An inspection station sta-tion permit shall be revoked by the Division whenever the permittee per-mittee voluntarily discon-' tinues the operation of the inspection in-spection station. All remaining inspection program materials shall be returned to the Division Divi-sion immediately upon revocation, revoca-tion, and the Division shall reimburse the permitee for unused un-used Inspection Reports and Certificates of Compliance that are in good condition. F. Abandonment: An inspection in-spection station permit shall be revoked and all inspection program materials seized by the Division when the permittee permit-tee abandons the place of business busi-ness and-or cannot be located. SECTION XIX SEVERABILITY In the event any section, subsection, or part of this ordinance ordin-ance shall be held invalid, unenforceable, or unconstitutional unconstitu-tional by any court of competent jurisdiction, such holding shall not invalidate or render unenforceable any other provision hereof.
