Show 4 . AN ORDINANCE AN ORDINANCE LEVING A SPECIAL IMPROVEMENT TAX IN CURB AND GUTTER DISTRICT NO. 1. Be it ordained by the ' City Council of Mt. Pleasant city: That whereas a notice of Intention to improve that certain part of State street in Mt. Pleasant, Utah hereinafter described and designated as Curb and Gutter District No. 1, by curbing and guttering the same, has been duly given by publication in the Mt. Pleasant Pleas-ant Pyramid of Mt. Pleasant, Utah, under dates as follows: May 11, 1928, May 18, 1928, May 25, 1928, and June 1, 1928. And whereas at or before the time fixed in the said, notice for the filing of objections to the said proposed im-povement, im-povement, the owners of two thirds of the front feet or square feet located by lot and blocks of the property fronting front-ing on the said street to be improved and especially benefited by said improvement, im-provement, did not file or make objections ob-jections to the said improvement or to the levying of a tax against the said benefited property for the payment thereof, and the city council did order the making of the said improvement. And whereas the making of the said improvement was thereafter duly and regularly let to a contractor and the said work has been done and is now completed and accepted. And whereas the city council did at its regular meeting held Oct. 6, 1928 appoint three of its members to constitute con-stitute a board of equalization and review, re-view, and said board did after completing com-pleting a list of the property to be assessed in the said district give notice of the completion of said list by publication in the Mt. Pleasant Pyramid Pyra-mid of Mt. Pleasant under date of October 19, 1928. And whereas the said board of equalization equal-ization and review did sit as such at the city hall in Mt. Pleasant, Utah, for three consecutive days, pursuant to the said notice, and the said board did after said sittings make its report to the city council approving the levy and assessment in the said district as hereinafter set out. Now therefore be it ordained: Section 1 That Curb and Gutter District No. I of Mt. Pleasant shall and does include and consist of the blocks, lots and parcels of lots herein 'described and that there be and there is hereby levied against the said district dis-trict for the purpose of paying the expenses ex-penses of the said improvement the sum of $1992.12, and that said sum be and it is hereby levied and assessed against the various lots and parcels of lots within the said District as follows: fol-lows: Curb and Gutter District No. 1 Name of Owner CHURCH OF JESUS CHRIST OF LATTER DAY SAINTS 1 Description of Land NW Corner of blk. 39, Plat Mt. Amount of Levy $151.99 Section 2 That the total levy hereby made does not exceed by more than 10 per cent the contract price for the said improvement. Section 3 That the apportionment of the levy upon the said district is made according to the frontage abut-'ting abut-'ting upon the said street within the said district and it is hereby found and determined that said district is benefited bene-fited by said improvement in an amount equal to or in excess of the levy hereby made and that each lot or parcel of lot within the said District is benefited in an amount equal to or in excess of the amount assessed and levied lev-ied against it. Section 4 That the tax hereby levied shall be payable in ten equal Installments, Install-ments, the first installment to be due and payable on the 15 day of Feoruary 1929, and one installment shall be due and payable each year thereafter on said date until the full amount of said levy and assessment has been paid: provided that more than one installment install-ment of the whole of said tax may be paid at any installment date, by paying the amount thereof with interest to the date of payment: all Installments, except the first herein provided, shall bear interest from the due date of the first installment above provided until due at the rate of seven per cent per annum, and said installments If not paid when due shall bear interest at the rate of 12 per cent per annum from said due date until paid- all Interest In-terest shall be payable annually. ' Section 5 Default in the payment of any installment of principal or Interest In-terest when due shall cause the whole of the unpaid principal to become immediately im-mediately due and payable, and the whole amount of said unpaid principal shall thereafter bear interest at the rate of 12 per cent per annum until paid. Section 6 The treasurer shall give notice of the levy hereby made and shall collect the assessment as provided pro-vided by law and all money collected hereunder shall be kept m in a special fund for the payment of the indebt-ness indebt-ness made against the levy.
