Whatever is dangerous to human life or health, and whatever renders soil, air, water or food impure or unwholesome, are declared to be nuisances and to be illegal, and every ev-ery person, either owner, agent or occupant, having aided in creating or contributing to the same, or who may support, continue or retain any of them, shall be deemed guilty of a misdemeanor. SECTION 395. No house refuse, offal, garbage, dead animals, decaying decay-ing vegetable matter or organic waste substance of any kind shall be thrown or allowed to remain upon or in any street, road, ditch, gutter, public place, private premises, vacant va-cant lot, water course, lake, pond, spring or well. section 396. No private vault, cesspool, or reservoir into which a privy, water closet, stable orjsink is drained, shall be established or permitted within fifty feet of any surface, well, spring or other source of water used for drinking or culinary culi-nary purposes, without written permission per-mission from the board ol health, based upon the advice of the medical medi-cal health officer. Whenever, in the opinion of the board of health or health officer, any privy, vault or cesspool has become the receptacle of infectious material from a contagious contag-ious or infectious disease or has become be-come a mi n r.ee to health, they shall have the power to order such privy or cesspool disinfected, or filled fill-ed in and abandoned. SECTION 397. UNCLEAN DRAIN OR GARBAGE RECEPTACLE. It shall be unlawful for any person to causa or permit, any unclean, stinking, foul, defective or filthy drain, ditch, tank, privy, privy box or gutter or any j leaking or broken slope, garbage or manure box, or receptacle of similar character to remain on his premises. SECTION 402. BREWERY, TANNERY, BARN, etc. It shall be unlawful for the owner or accupant .of any tannery, tan-nery, livery stable, barn, laundary, creamery or factory of any kind, place or premises, to permit the same to beeom .-: ndisome, foul or offensive. |
