Constitutional Amendment No. 1 A Joint Resolution Proposing an Amendment Amend-ment of Section 1. of Article VII. of the Constitution Relating to the State Executive Execu-tive Department, the Terms, Residence and Duties of Officers. (Superintendent of Public Instruction.) Be it resolved by the Legislature of the State of Utah, two-thirds of all the members mem-bers elected to each house concurring therein : SECTION 1. That it is proposed to mend Section 1, of Article VII. of the Constitution of the State of Utah as folio''1 fol-io''1 i SECTION 1. All ..tangible property in the State, not exempt under the laws of th. United States, or under this constitution, shall be taxed in proportion to its valueto be ascertained as provided by law. The property of the . United States, of the Slate, counties, cities-,, towns, school districts, municipal mu-nicipal corporations :a,id public libraries, lots with the buildings thereon used exclusively exclu-sively for either religious worship or charitable-purposes, and places of burial not held or used fora private or corporate benefit, bene-fit, shall be exempt from taxation. Water rights, ditches, canals, reservoirs, power plants; puiriping plants, transmission lines, pipes and flumes owned and used by individuals indi-viduals or corporations for irrigating lands within the state owned by such individuals or corporations, or the individual members thereof, shall, not be -separately taxed as long as they- shall be owned and used exclusively ex-clusively for such purposes. Power plants, power transmission -lines and other property-used fox; generating, and delivering electrical elec-trical power, a portion of which is used for furnishing .power for pumping water for irrigation purposes on lands In the State of Utah, may be exempted from taxation taxa-tion to thej. extesit. that such property is used for aucli. -purposes.- These exemptions shall accrue to tbe benefit of the users of water so pumped" -under such reflations as the legislature may prescribe. The taxes of the indigent -poor- may be remitted or abated .at such .-.times -and in such maner as may be provided by-law. The legislature may provide for the, exemption from taxation taxa-tion of . homes,; homesteads, and personal property, not to exceed $2,000 in value foi election, except that the terms of office of those elected at the first election shall begin when the state shall be admitted into the Union, and shall end on the first Monday Mon-day in January, A. D. 1901. The officers of the Executive Department, during their terms of office, shall reside at the seat of government, where they shall keep the public pub-lic records, books and papers. They shall perform such duties as are prescribed by this Constitution and as may be prescribed by law. SECTION 2. The Secretary of State Is hereby directed to submit this proposed amendment .to the electors of the state at the next - general election in the manner provided by law. SECTION 3. Constitutional Amendment No. 2 A Joint Resolution Proposing an Amendment Amend-ment to Section 10, of Article VII. of the Constitution Relating to Governor's Appointive Ap-pointive Power and the Filling of Va- . cancies in Certain Offices. (Superintendent (Superin-tendent of Public Instruction.) Be it resolved by the Legislature of the State of Utah, two-thirds of all the - members elected t each, house concurring concur-ring therein: SECTION 1. That it is ' proposed to amend Section 10, of Article VII, of the Constitution of the State of Utah,' as follows fol-lows : - SECTION 10. The Governor shall nominate, nom-inate, and by and with the consent of the Senate, appoint all State and district officers offi-cers whose offices are established by this Constitution, or which may be created by la-w, and whose appointment or election is not otherwise provided for. If. during the recess of the Senate, a vacancy occur in any State or district office, the Governor hall appoint some fit person to discharge the duties thereof until the next meeting of the Senate, when he shall nominate some person to fill such office. If the office of justice of the supreme or district court. Secretary of State, State Auditor, State Treasurer, or Attorney-General be vacated by death, resignation or otherwise, it shall be the duty of the Governor to fill the same by appointment, and the appointee shall hold his office until his successor shall be elected and qualified, as may be by law provided. SECTION 2. The Secretary of State ts hereby directed to submit this proposed amendment to the electors of the state at the next general election in the manner provided by law. SECTION 3. Property not to exceed $3,000 in value, owned by disable person who served in any war in the military service serv-ice of the United States or of the State of Utah and by the unmarried widows and minor orphans of such persons may be exempted ex-empted 'as the legislature may provide. The legislature shall provide by law for an annual tax sufficient, with other sources of revenue, to defray the estimated ordinary ordin-ary expenses ot the state for each fiscal year. For the purpose of paying the state debt. If any there be, the legislature shall provide for levying, a tax annually, sufficient suffi-cient to pay the annual interest and to pay the principal of such debt, within twenty years from the final passage of the law creating the debt.
