Show NO DEADLY WEAPON USED George Washburn was cleared in police court this morning of the charge of committing assault with a deadly weapon on L. W. Dykeman. None of the witnesses to the fight between the two men had seen Washburn Wash-burn use anything In the way of a deadly weapon, except his fist. The trouble between Washburn and Dl;eman occurred September 1" in the Little Queen saloon, on Washington Washing-ton avenue. Dykeman swore thai the lie had passed and that Washburn struck him. This was as far as his memory went. He could not tell whether Washburn had struck him with his fist or with n mcat-ax. When he recovered consciousness he had a doep cut over his eye and a bruise on the hack of his head. Dykcuia i's wife swore to the complaint, charging Washburn with using a knife but she, of course, had not seen the affray. Other witnesses to the fight stated that Washburn had used only his fists and the physician who atlcndvl the injured man did no think the wounds he dressed wore Knife wounds. Police Judge .1. I. Murphy dismissed dis-missed the action with the statement that no evidence had been produced to show that a deadly weapon had been used. j |
