The defendants arecharged with involuntary in-voluntary manslaughter, alleged to have been committed January 1st. 1910, when Parker Elwnod Faut was run over by an automobile at fhe intersection in-tersection of Washington avenue and Twenty-third street and killed . "' Jt i will be remembered that Ic-Faut Ic-Faut was killed on that day and at the place designated,, and a coroner V jurv after hearing. the 'testimony rendered ren-dered a vtrdlct that tho man came io his death by being run over by' an automobile belonging to llliam i Howell, and operated by him at thp time. The evidence at tho coroner's Inquest also showed that the other defendants, de-fendants, Messrs. Larsous and Kennedy, Ken-nedy, were riding In tho machine, the gue6ts-of Mr. Howell. Mr. Faut's body was. taken to El-wood, El-wood, Illinois, where It was burled In the cemetery of his old home, the-re mains being accompanied to their final fin-al resting place by the widow. Mr. Faut was in the court room this morning morn-ing as a witness In . the case, sho being be-ing represented by her lawjer, H. II. Henderson. County Attorney David Jensen Is conducting the case for the stale. Attorneys T. D. Johnson, Joiin E. Barley and George Halverson ai pearing for the defendants. . It is understood that a compromise as to damages has been entered Into between the defendant and Mrs Faut, she to receive $3,ooo, and the case not to be brought to l3sue in the criminal crim-inal courts. i County-Attorney Jensen slates thai the offense, charged Is a misdemeanor and may be compromised by the par- ' ties immediately aggrieved. Mrs. Faut is tbe complainant In the case and the presumption is that, according ac-cording to' the terms of the compromise, comprom-ise, she will not-Insist on a further prosecution. |
