Show HARRY L. KEMP WINS IN THE DISTRICT COURT Jury Renders Verdict Against Utah Association of Credit Men For $712.82. Salt Lake. March 17. Harry L. Kemp won in the Third district court Tuesday, in his suit against the Utah Association of Credit Men and William R. Clark, to recover damages for the illegal seizure by the Credit Men's Association As-sociation of the Clark drug store, at Eleventh' East and Twelfth South streets, and the conversion of the stock and fixtures. By a jury in Judge Ritchie's division Kemp was given a verdict for $712.83, upon special findings. Kemp set out in a verdict that on June 1. 190S, he leased the drug store from Clark for six months, Clark to get 50 per cent of the net proceeds, payablo monthly. On the same date they entered Into a supplemental agreement whereby Kemp was to get $75 a month salary as managor, to be charged to the regular running expense ex-pense account. The stock, when Kemp took charge, was worth $3,400, Kemp set out. Ho had added approximately $!)75 to the stock and sold approximately that much stock when the credit men and Clark, on September 23. 1908. conspired con-spired together to defraud him out of his rights and interests, and, seizing seiz-ing the store, converted the goods to tholr own use, Kemp alleged. Kemp originally asked for damages in the sum of (2314.55. but this was subsequently reduced to the amount of tho judgment obtained Tuesday. The jury found that Kemp, at the time of tho seizure of the etore. had earned earn-ed unpaid salary amounting to $171, and was entitled to earned, but unpaid, un-paid, commissions, to the amount of $19183. It further found that he was entitled to $175 for salary he would havo earned from tho date of the seizure seiz-ure until the expiration of the lease, had he not been molested, and estimated esti-mated that he would have received future fu-ture commissions lo the amount of $175, and entered a verdict according ly. for $712 83. |
